RECOMMENDATION:
Recommendation Concerning the United States Department of Agriculture Natural Resources Conservation Service Emergency Watershed Program Project Agreement - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the United States Department of Agriculture (USDA) Natural Resources Conservation Service (NRCS) Emergency Watershed Project (EWP) Program Project Agreement:
 
A. Authorize the Chairman or Vice Chairman to continue to execute any subsequent Agreements and Program-related documents from the project list, subject to legal review and sign-off;
 
B. Approve and authorize the Chairman or Vice Chairman to sign Amendment No. 3, which is a time extension and budget increase for the USDA/EWP Program Project Agreement;

C. Authorize an increase in funding for the following projects, in the amount of $438,800, being equal to a federal share of $329,100, and a County share of $109,700, and increase in technical services from 10% to 12%;

BACKGROUND:
The April 2014 storms produced floodwaters throughout Escambia County. Swollen streams caused excessive flooding and erosion that damaged many roadways, dams, culverts, and bridges. 

Meeting in regular session on June 26, 2014, the Board voted to authorize submittal of these projects for consideration for the USDA-NRCS Emergency Watershed Program (EWP). This previous Board action authorized the Chairman to execute, subject to legal review and sign-off, easements, hold-harmless agreements, and other documents of conveyance that may be required from property owners of Escambia County whose properties are adjacent to designated NRCS project sites.

Meeting in regular session on April 9, 2015, the Board voted to authorize execution of appropriate documents to award Design and Construction Contracts for the NRCS projects and to ratify the contracts at the board meeting immediately following the Bid Opening.

This program reimburses 75% of the actual eligible construction costs, and reimburses eligible in-kind technical services not to exceed 7.5% of the actual eligible construction cost.  Amendment #3 increases the in-kind technical services to 12% of the actual eligible construction cost.  Amendment #3 increases the construction cost by $438,800 and extends the grant expiration date to September 24, 2016.

Change Order #3 for the Ten Mile Creek Restoration Project is an additive change, in the amount of $257,200, to the previous contract amount of $1,667,468.20, and is a cumulative increase of 15.38% to the original contract price of $1,672,498.20. This change consists of an increase in earthwork fill, tied concrete block, rip rap, and other items needed to complete this project.  The quantity of fill in the contract is insufficient to complete the project because quantities did not adequately account for continuing erosion since the survey was done over 1 year before project started. Tied concrete block proved too difficult to handle in full design width requiring use of narrower runs which added seams, increasing the quantity required. After review by NRCS, the Engineer of Record (EOR) and the Stream Expert determined that additional areas of tied concrete block were needed for bank stability. The EOR and Stream Expert also determined that additional rip rap is needed to stabilize the toe of the tied concrete block on the banks. 

After meeting with NRCS staff onsite for the projects under this agreement, NRCS staff identified additional improvements to ensure future sustainability. A formal request was submitted to NRCS for additional funds for reimbursement of these and other project expenses. The request was approved by NRCS, with the updated NRCS agreement implementing the funding increase included in Amendment #3.
BUDGETARY IMPACT:
Funding for the 25% match is available in Fund 352 "LOST III, Project #15EN3252" and Funding for the Change Order is available in Fund 112 "Disaster Recovery Fund", Cost Center 330493, Project #ESDCE31.
LEGAL CONSIDERATIONS/SIGN-OFF:
Stephan West, Assistant County Attorney, has reviewed and approved to legal sufficiency Amendment #3.

The Public Works Department will coordinate with the United States Department of Agriculture (USDA) Natural Resources Conservation Service (NRCS).
