RECOMMENDATION:
Recommendation Concerning the Acquisition of an Access Easement Located Along Whitetail Lane and Booner Circle Within Deer Run Subdivision - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the purchase of an access easement (approximately 5.0 acres), located along Whitetail Lane and Booner Circle within Deer Run Subdivision on Beulah Road, from Beulah Properties, LLC, :  

A. Authorize the purchase of an access easement (approximately 5.0 acres), located along Whitetail Lane and Booner Circle within Deer Run Subdivision, for the agreed upon price of $30,000, from Beulah Properties, LLC, in accordance with the terms and conditions contained in the Contract for Sale and Purchase  (NOTE:  CONTRACT FOR SALE AND PURCHASE WILL BE DISTRIBUTED UNDER SEPARATE COVER)

B. Approve the Contract for Sale and Purchase for the purchase of an access easement (approximately 5.0 acres), located along Whitetail Lane and Booner Circle within Deer Run Subdivision on Beulah Road; and

C. Authorize the County Attorney's Office to prepare, and the Chairman or Vice Chairman to execute any documents, subject to Legal review and sign-off, necessary to complete the acquisition of this access easement, without further action of the Board.

BACKGROUND:
On April 7, 2011, the County, through the exercise of its power of eminent domain, acquired certain real property for the purpose of maintaining a system of groundwater monitoring wells located south of the Perdido Landfill. These wells are monitored pursuant to an amended consent order and remedial action plan approved by the Florida Department of Environmental Protection (FDEP).  The County's obligation to maintain groundwater monitoring wells on the property, as required by FDEP, is expected to continue for the foreseeable future, and constitutes a need to acquire a recorded Access Easement. Whereas the appraised value of the easement property is valued at $6,000, the County acknowledges that it should share in the cost of usage, care and maintenance over the life of the improved property. Therefore, the contract price of the Access Easement is $30,000. Approval of this contract amount will require a super majority vote.
BUDGETARY IMPACT:

Funding for this project is available in Fund 401, Solid Waste Fund, Cost Center 230315, Projects, Object Code 56801.

LEGAL CONSIDERATIONS/SIGN-OFF:
The Contract for Sale and Purchase and Access Easement were approved as to form and legal sufficiency by Stephen West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139 of the Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will maintain compliance with Section 46-139 of the County Codes.
