RECOMMENDATION:
Recommendation Concerning the State of Florida Department of Transportation Intersection Safety Off System Project Maintenance Agreement - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the State of Florida Department of Transportation (FDOT) Off System Project Maintenance Agreement, related to a 100% Federally-Funded Safety Improvement Project that is being coordinated by the FDOT and involves performing safety enhancements to 59 stop-controlled intersections throughout the County:

A. Approve the State of Florida Department of Transportation Off System Project Maintenance Agreement; and

B. Authorize the Chairman to sign the State of Florida Department of Transportation Off-System Project Maintenance Agreement.
BACKGROUND:
This project is a 100% Federally-Funded Safety Improvement Project that is being coordinated by the Florida Department of Transportation and involves performing safety enhancements to 59 stop-controlled intersections throughout the County. The intersections in need of enhancement were previously identified by the Florida Department of Transportation (FDOT) and the Federal Highway Administration (FHWA). The safety enhancements planned include installation of additional or oversized signage, pavement marking installation or refurbishing, and pedestrian enhancements to sidewalks and crosswalks. The requested Maintenance Agreement is a program requirement of the FDOT, designed to document the County’s concurrence that they will include the constructed improvements as part of their Maintenance Program, but only for those aspects of the project constructed in county rights of way.

It should be noted that staff has a concern regarding a provision in the agreement that requires the County to fund any overages that are not covered by the FHWA. This provision is part of the standard agreement with local entities throughout the state. County staff has been assured by FDOT that all overages are typically covered by the FHWA, especially since this agreement is related solely to above ground enhancements; signage, striping, curbing, sidewalk, etc. 

Specific potential cost to the County cannot be determined since the possible cost is generally related to in-field utility impacts in the County r/w that are not anticipated as part of the project.
BUDGETARY IMPACT:
Project is federally funded under a program entitled "Florida's Statewide Safety Intersection Implementation Plan."
