RECOMMENDATION:
Recommendation Concerning Railroad Reimbursement Agreement for County Road 99 - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the Railroad Reimbursement Agreement, Grade Crossing Traffic Control Devices, between the State of Florida Department of Transportation (FDOT), Alabama Gulf Coast Railway, LLC, and Escambia County Board of County Commissioners:

A. Adopt the Resolution authorizing execution of the Agreement;

B. Approve the Railroad Reimbursement Agreement for the installation and future maintenance of the following Alabama Gulf Coast Railway, LLC, automatic grade crossing signals:

BACKGROUND:
The Florida Department of Transportation proposes to have Grade Crossing Traffic Control Devices installed at the existing Rail/Highway crossing on County Road 99 as shown on the attached Agreement. This project is scheduled for completion of negotiations by March 31, 2016. 

The State of Florida Department of Transportation (FDOT) is responsible for railway safety at all public crossings throughout the state of Florida. FDOT will fund the improvements to be performed by Alabama Gulf Coast Railway, LLC, as stated in the Agreement. The Agreement further states that Escambia County and Alabama Gulf Coast Railway, LLC, will equally share the annual maintenance costs associated with the grade crossing signals. This is a standard Agreement that FDOT uses for all railroad crossing control on county roads to document the responsibilities for the railroad company, county, and FDOT.

Once installation of the signal is completed, 50% of the expense in maintaining the same shall be borne by the County and 50% shall be borne by the FDOT.  This is a Class III Signal and the total annual maintenance cost is $3,402.  Escambia County will be responsible for $1,701 annually for this location.
BUDGETARY IMPACT:
Funding is available in Fund 175, Transportation Trust Fund, Account 211201/54601.  The annual maintenance fee for this signal will be $1,701 for Escambia County and $1,701 for FDOT for a total of $3,402.  This amount will be included on the annual billing statement from Alabama Gulf Coast Railway, LLC (attached are the anticipated charges for this year).
LEGAL CONSIDERATIONS/SIGN-OFF:
Kristin Hual, Assistant County Attorney, has reviewed and signed off on the Agreement and Resolution with the inclusion of a notation that there is a provision in the Agreement stating that the venue for any action arising out of this Agreement shall be in Leon County, Florida.
