RECOMMENDATION:
Recommendation Concerning the Release of a Portion of an Existing Conservation Easement to the Florida Department of Transportation - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the release of a portion of an existing conservation easement containing approximately 17,211 square feet to the Florida Department of Transportation to help facilitate improvements along Nine Mile Road:

A. Approve the Release of Conservation Easement releasing 17,211 square feet to FDOT; and

B. Authorize the Chairman to sign, subject to Legal review and sign-off, the documents necessary to release the Conservation Easement to FDOT.
BACKGROUND:
A Conservation Easement was recorded over a portion of the property located at 5565 West Nine Mile Road in association with a 2009 site plan minor (Leisure Lakes RV Park Expansion – DRC# 08041783), as mitigation for impacts to jurisdictional wetlands. Escambia County was identified as the grantee of the Conservation Easement. The original Conservation Easement included more than the minimum acreage required to offset the functional loss to wetlands. The Florida Department of Transportation has requested that Escambia County release 17,211 square feet of the original Conservation Easement to facilitate improvements to Nine Mile Road. Wetlands located within the boundary of the remaining Conservation Easement will still be subject to the original terms and conditions. Wetlands to be released from the existing Conservation Easement will be subject to current county environmental regulations, including permitting and mitigation requirements.
BUDGETARY IMPACT:
FDOT will record the Release of Conservation Easement.
LEGAL CONSIDERATIONS/SIGN-OFF:
The County Attorney’s Office has reviewed and approved the Release of Conservation Easement.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:

IMPLEMENTATION/COORDINATION:
Upon Board approval and subsequent execution of the documents by the Chairman, the documents will be filed in the public records of Escambia County, Florida.
