RECOMMENDATION:
Recommendation Concerning the Donation Agreement for Property Located at 5806 Bob O Link Road from the Trust for Public Land - Joy D. Blackmon, P.E., Public Works Department Director

That the Board approve and authorize the Chairman or Vice-Chairman to sign the Donation Agreement for the donation of real property (approximately 3.38 acres), located at 5806 Bob O Link Road, from the Trust for Public Land to Escambia County, in accordance with the terms and conditions contained in the Agreement.

BACKGROUND:
Escambia County was selected to receive funding through Phase V of the Natural Resources Damage Assessment (NRDA) process whose goal is “to enhance public access to natural resources and increase recreational opportunities.” The selected project includes the acquisition of a 3.38 acre property at 5806 Bob O Link Road, development of amenities, and funds to provide ten years of operation and maintenance costs. The total value of the park and ten years of maintenance is estimated to be $6.35 million. The site is adjacent to the Galvez boat ramp to the west.     
 
The Trust for Public Lands is tasked with acquiring the property, site design, site development, and donating the final product to the County, including ten years of operation and maintenance funding. The Donation Agreement provides assurance to the Trust for Public Lands that the County intends to take possession of the donated waterfront park at the end of the process.
BUDGETARY IMPACT:
The County will receive the park after it is acquired and fully developed. Anticipated costs to the County include acquisition of an as-built survey and an updated title insurance policy. After the initial ten years of operations and maintenance funding runs out, the County will be responsible for ongoing park maintenance.
LEGAL CONSIDERATIONS/SIGN-OFF:
The County Attorney's Office has reviewed and approved the Donation Agreement.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
N/A
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will maintain compliance with Section 46-139 of the County Codes.
