RECOMMENDATION:
Recommendation Concerning the Conveyance of a Utility Easement at Brent Athletic Park to Emerald Coast Utilities Authority - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the conveyance of a 0.009 acre utility easement located at Brent Athletic Park to Emerald Coast Utilities Authority (ECUA):

A. Approve the utility easement conveying 0.009 acres of real property located at Brent Athletic Park to ECUA; and

B. Authorize the Chairman to sign, subject to Legal review and sign-off, the necessary documents granting the utility easement to ECUA.

[Funding:  Funds for incidental expenses associated with the recording of County documents are available in Engineering Escrow Account accessed by the Escambia County Clerk's Office.  ECUA will be responsible for the recording of all ECUA documents]
BACKGROUND:
Brent Athletic Park is located on "W" Street with Bayliss Court as its southernmost boundary. ECUA intends to make improvements along "W" Street and to facilitate their project has requested an easement in the southeast corner of Brent Athletic Park, located at the intersection of "W" Street and Bayliss Court. Conveyance of the 0.009 acre easement will not interfere with any existing improvements at the park.

The proposed easement will not interfere with the proposed design of the improvements of Brent Athletic Park. Escambia County Parks Department has reviewed this request as well and has no objections.
BUDGETARY IMPACT:
All costs associated with accepting and recording of documents will be borne by ECUA.
LEGAL CONSIDERATIONS/SIGN-OFF:
The County Attorney’s Office has reviewed and approved the utility easement.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
N/A
IMPLEMENTATION/COORDINATION:
Upon Board approval and subsequent execution of the documents by the Chairman, staff will transfer the documents to ECUA for acceptance and recording in the public records of Escambia County, Florida.
