RECOMMENDATION:

Recommendation Concerning the Approval and Adoption of Revised Civil Citation Forms.

That the Board take the following action:

A. Approve and adopt the revised Animal Control Civil Citation form; and

B. Approve and adopt the revised Civil Citation form for Santa Rosa Island.

BACKGROUND:

The County Attorney’s Office is requesting that the Board approve and adopt the revised Animal Control Civil Citation form and the Civil Citation form for Santa Rosa Island. The revised forms include updated instructions regarding court appearances and further specify the applicable filing fee and court costs ($15) assessed against the violator in addition to the civil penalty. The citation form for Santa Rosa Island was also revised to specify the applicable delinquent fee ($10) for late payments and a reference to Section 6-4 of the Code of Ordinances relating to alcoholic beverages in public areas on Pensacola Beach. The $15 filing fee and court costs and, when applicable, the $10 delinquent fee are currently added to the total civil penalty amount but were not previously accounted for in the citation form so as to provide sufficient notice to the violator.

The citation forms were revised by Assistant County Attorney, Kristin D. Hual.

POLICY/REQUIREMENT FOR BOARD ACTION:

Section 10-7 of the Code of Ordinances specifies that Animal Control Citations shall be in the form prescribed by the Board of County Commissioners.

Section 30-63 of the Code of Ordinances applicable to the civil citation form for Santa Rosa Island specifies that a citation shall be in the form prescribed by the county administrator and further specifies the content that shall be contained in the citation form along with a civil penalty citation schedule. This provision did not, however, expressly provide for the assessment of any fees or costs in addition to the civil penalty.

IMPLEMENTATION/COORDINATION:

The revised citation forms were reviewed by Escambia County Sheriff’s Office and the Clerk of the Court.
