Issue:    Escambia County’s Acceptance of Property from Florida Department of Transportation (FDOT)

RECOMMENDATION:
Recommendation Concerning the County’s Acceptance of Property on West Roberts Road From the Florida Department of Transportation - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning Escambia County’s acceptance of property for retention pond purposes on West Roberts Road from the Florida Department of Transportation (FDOT):

A. Accept the transfer of real property from FDOT to Escambia County for retention pond purposes on West Roberts Road;
 
B. Authorize the payment of incidental expenses associated with the recording of the documents; and

C. Authorize the Chairman or Vice Chairman to sign any documents, subject to Legal review and sign-off, necessary to complete the acceptance of these properties.

BACKGROUND:
As part of the Joint Use Pond Agreement for the State Road 10 (US 90/Nine Mile Road) Project, FDOT is conveying their parcel, located on West Roberts Road, to Escambia County for retention pond purposes. 

This parcel has been identified in the 11 Mile Creek Regional Pond Study and is included in Escambia County's Needs Assessment Report. By obtaining this parcel, Escambia County will be able to alleviate current and potential future flooding, damage to residential properties, roads and existing drainage infrastructure, which is a clear indication of public purpose.

Approval of Agenda Item AI-9766 (Joint Use Pont Agreement) is needed prior to the acceptance of this parcel.

Board acceptance is required for the conveyance of these properties to Escambia County.
BUDGETARY IMPACT:
Funds for the recording of documents for these projects are available in the Engineering Escrow Account accessible by the Clerk’s office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Quit Claim deed has been reviewed and approved by the County Attorney’s Office.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
County staff will maintain compliance with Section 46-139 of the County Codes.
IMPLEMENTATION/COORDINATION:
Upon Board approval, the Quit Claim deed will be recorded in the public records, with copies provided to FDOT.
