RECOMMENDATION:
Recommendation Concerning a License Agreement with the Florida Department of Transportation for the State Road 10 (US 90/Nine Mile Road) Improvement Project - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning a License Agreement between Escambia County and the Florida Department of Transportation (FDOT) for their planned improvement project for a portion of State Road (SR) 10 (US 90/Nine Mile Road), from Beulah Road to SR 297 (Pine Forest Road):

A. Approve the License Agreement between Escambia County and FDOT for their planned improvement project for the portion of SR 10 (US 90/Nine Mile Road), from Beulah Road to SR 297 (Pine Forest Road);

B. Adopt the Resolution authorizing the License Agreement between Escambia County and FDOT for their planned improvement project for the portion of SR 10 (US 90/Nine Mile Road), from Beulah Road to SR 297 (Pine Forest Road); and

C. Authorize the Chairman to execute the License Agreement, Resolution, and all other documents related to the conveyance, subject to Legal review and sign-off, without further action of the Board.
BACKGROUND:
FDOT has a multi-lane roadway construction and drainage improvement project designed for SR 10 (US 90/Nine Mile Road) from Beulah Road to SR 297 (Pine Forest Road). FDOT is requesting that the county grant a License Agreement to them to facilitate their project. The License Agreement is for Escambia County to grant FDOT the right to occupy and perform construction work that will adequately tie in various county road right-of-way areas that intersect with the Nine Mile Road project. FDOT will be responsible for all costs associated with this request, including the recording of documents.  

Staff has reviewed this request and determined that the conveyance of this License Agreement will have no adverse impact to the county and has no objections to the conveyance of the License Agreement.
BUDGETARY IMPACT:
All costs associated with accepting and recording of documents will be paid by FDOT.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Resolution and License Agreement were approved as to form and legal sufficiency by Stephen West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
