RECOMMENDATION:
Recommendation Concerning Amendment to Agreement for Recyclable Paper Materials - Patrick T. Johnson, Waste Services Department Director

That the Board approve the Amendment to Agreement for Recyclable Paper Materials, PD 13-14.067, between Escambia County, Florida, and Allied Waste Services of North America, LLC, to include a processing fee at a rate of $37.50 per ton for all materials delivered by the County to the Company's materials recovery facility.

BACKGROUND:
On September 4, 2014, the Board of County Commissioners awarded Contract #PD 13-14.067, Solid Waste Recycling, to Allied Waste Services of North America, LLC, at no cost to the County, and approved the Agreement for Recyclable Paper Materials between Escambia County ("County") and Allied Waste Services of North America, LLC (Company").

Item 2. (PAYMENT) of the Terms and Conditions states: "Company reserves the right to, in the future and in its sole discretion, charge County for Company's acceptance and processing of Paper Materials, (a "Processing Fee"), and in such event shall provide ten (10) days prior written notice to County of Company's intent to charge such Processing Fee".  The Agreement further provides that the County may either agree to pay the fee by way of a written Amendment to the Agreement, or reject the Processing Fee and terminate the agreement with seven (7) days prior written notice. 

On July 1, 2015, Allied Waste Services of North America, LLC submitted written notice of its intent to charge the County a processing fee in the amount of $37.50 per ton for all Paper Materials delivered by the County to the Company's facility, effective July 13, 2015.    
BUDGETARY IMPACT:
Funding for this Amendment to Agreement is available in Fund 401, Solid Waste Fund, Cost Center 230306, Object Code 53401.
LEGAL CONSIDERATIONS/SIGN-OFF:
Assistant County Attorney, Kristin Hual, has approved the Amendment to Agreement for Recyclable Paper Materials (PD 13-14.067) as to form and legal sufficiency.

POLICY/REQUIREMENT FOR BOARD ACTION:
Board approval is required in order to amend agreements entered into by the Board.
IMPLEMENTATION/COORDINATION:
A copy of the Amendment to Agreement for Recyclable Paper Materials (PD 13-14.067) will be provided to Allied Waste Services of North America, LLC after the Clerk's Office has completed processing.
