RECOMMENDATION: |
Recommendation Concerning the Surplus and Sale of Brent Athletic Park Parcels - Stephan Hall, Budget Manager, Management and Budget Services
That the Board take the following action concerning the surplus and sale of Brent Athletic Park Parcels:
A. Declare surplus two of the Board's real properties located in the Brent Athletic Park, specifically Reference Number 46-1S-30-1105-000-003 (Account Number 04-2392-140), and Reference Number 46-1S-30-1105-000-002 (Account Number 04-2392-120);
B. Authorize an appraisal to be performed on each parcel to determine the current market value(s);
C. Authorize the minimum sale amount(s) to be determined by the County Administrator, or his designee, at or above the minimum appraised value(s);
D. Authorize the marketing and sale of the properties to be performed by the Real Estate Brokerage Service provider chosen in response to the Request for Proposal, Specification Number PD 15-16.008, in accordance with Escambia County Ordinance 46-132;
E. Authorize sale of the properties to the highest offer received at or above the minimum sale amount(s); and
F. Authorize the County Attorney's Office to prepare, and the Chairman to sign all documents necessary to complete the sales of these properties, without further action of the Board.

BACKGROUND: |
The County owns the subject park properties as dedicated by plat of the Brentwood Park Subdivision (Plat Book 1 Page 11) that was dedicated for public use on March 15, 1926. Most of the property is being utilized by the Brent Athletic Association for baseball and football fields. The portion of the property lying north of Beverly Parkway (Reference # 46-1S-30-1105-000-002) is where the current football field is located. The County would like to relocate the football complex to the most southerly portion of the County park property. A very rough draft of the site plan layout is attached to this recommendation. The County does not have a need for the property where the current football field is, nor the property lying immediately south of Beverly Parkway (Reference # 46-1S-30-1105-000-003) and desires to sell it.
Florida Statutes 95.36 allows a county to sell land dedicated to the public as a park if the dedication has been recorded for 30 years, so that criteria is met. This section further requires that any funds accruing to the municipality or county from the sale of dedicated lands pursuant to this section shall be used for park purposes.
The zoning of both properties is Heavy Commercial - Light Industrial. The Future Land Use of these properties has been changed from Recreation to Commercial per Small Scale Amendment 2015-04 and Small Scale Amendment 2015-05.
For many years, Brent youth athletics have been hosted on these properties. The relocation of these amenities will provide a safer, user-friendly athletic environment to the participants and attendees in the Brent Youth Sports Complex.
Lamar (Advertising) Companies currently leases sign space on the subject properties. Contracts between Lamar and Brent Recreation Association may be affected, subject to sale of these parcels. Copies of lease agreements are attached.
Funds generated by the sale of these properties must be used for the Brent Athletic Park renovation. |

LEGAL CONSIDERATIONS/SIGN-OFF: |
All legal documents will be approved as to form and legal sufficiency by the County Attorney's Office prior to execution by the Chairman. The purchaser will pay all closing costs. |

Parks and Recreation, Engineering, Management & Budget Services, and selected Real Estate Brokerage Service provider will coordinate to achieve sale of these properties. |
