RECOMMENDATION:
Recommendation Concerning the Acceptance of a Drainage Easement on Alexandria Drive - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the acceptance of the donation of a Drainage Easement from Thomas J. McKean and Alif A. McKean, located at 1104 Alexandria Drive:

A. Accept the donation of a drainage easement, located at 1104 Alexandria Drive, from Thomas J. McKean and Alif A. McKean; 

B. Authorize the payment of documentary stamps as the drainage easement is being donated for governmental use, which is for drainage improvements, and the County benefits from the acceptance of the drainage easement, which enhances the safety and well-being of the citizens of Escambia County;
 
C. Authorize the payment of incidental expenditures associated with the recording of documents; and

D. Authorize staff to prepare, and the Chairman or Vice Chairman to accept the Drainage Easement, subject to Legal review and sign-off, as of the day of delivery of the Drainage Easement to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

BACKGROUND:
A drainage complaint was received regarding the existing drainage infrastructure located on the north side of this property.  There is an existing drainage pipe in place, however, there has not been any evidence of a recorded drainage easement for this parcel. 

The existing corrugated metal pipe is corroded, is taking on sand, and eroding property around it. The County has a project in design to replace the existing subsurface metal pipe with a 48" diameter high-density polyethylene pipe (HDPE).  This easement is needed for construction of this project and would connect with an existing drainage structure that runs North to Massachusetts Avenue. Upon completion, these improvements will benefit both Chasefield and Mayfair Subdivisions.

Board approval is required for the acceptance of the donated Drainage Easement.
BUDGETARY IMPACT:

Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by the Escambia County Clerk's Office.

LEGAL CONSIDERATIONS/SIGN-OFF:
The Drainage Easement was approved as to form and legal sufficiency by Stephen West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will proceed in compliance with Section 46-139 of the County Codes.
