RECOMMENDATION:
Recommendation Concerning Acceptance of the Donation of Real Property Located off Massachusetts Avenue - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning acceptance of the donation of a portion of real property located off Massachusetts Avenue for drainage improvements:

A. Accept the donation of real property containing 0.48 acres, located on Massachusetts Avenue from Columbus A. Hobbs, III, for drainage improvements;

B. Authorize the payment of documentary stamps because the property is being donated for governmental use, which is for sidewalk and drainage improvements, and the County benefits from the acceptance of this property, which enhances the safety and well-being of the citizens of Escambia County;

C. Authorize the payment of incidental expenditures associated with the recording of documents; and

D. Authorize staff to prepare, and the Chairman or Vice Chairman to accept, the Warranty Deed as of the day of delivery of the Warranty Deed to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

BACKGROUND:

The donated parcel is located on the south side of Massachusetts Avenue, west of Erress Boulevard (Block H of Westernmark Subdivision).  There is an existing ditch located between the subdivision, and Mr. Hobbs' property, that the County has been maintaining for many years.  This ditch serves as a drainage system for the subdivision, however, the easement for the ditch was not correctly identified on the plat.  By accepting Mr. Hobbs' property, the Road Department will be better able to access the ditch, maintain it, and widen it with gentler side slopes.  This approach will ultimately reduce maintenance costs for the Road Department.  

Mr. Columbus A. Hobbs, III, has agreed to donate 0.48 acres of property to help with improving the drainage in this area. Board approval is required for acceptance of the donated property.

BUDGETARY IMPACT:
Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by Escambia County Clerk's Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Warranty Deed was approved as to form and legal sufficiency by Stephen West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will proceed in compliance with Section 46-139 of the County Code of Ordinances.
