Recommendation Concerning Intervening in the Florida Retirement System Appeal Filed By Employee Daniel Smillie, Jr.

That the Board authorize the County Attorney's Office to intervene in the Florida Retirement System (FRS) appeal filed by employee Daniel Smillie, Jr. regarding qualification as a Special Risk Class.

BACKGROUND:

Road Supervisor, Daniel Smillie, Jr., previously requested reclassification to Special Risk Class based on work with inmate crews. The County determined he did not qualify and FRS has listed him as ineligible. Mr. Smillie has filed an administrative appeal of that decision. Should the decision be overturned, the County would be obligated to retroactive contributions.
