RECOMMENDATION:
Recommendation Concerning Acceptance of the Affordable Housing Incentive Plan Review Report - Tonya Gant, Neighborhood & Human Services Department Director

That the Board accept the Affordable Housing Incentive Plan Review Report (Report) as prepared by the Affordable Housing Advisory Committee (AHAC), authorize the County Administrator to sign that the Report was received by the Board, and authorize staff to submit the Report to Florida Housing Finance Corporation (FHFC).
BACKGROUND:
In 2008, the Board adopted Resolution 2008-203, adopting the initial Affordable Housing Incentive Plan (Plan), which was subsequently incorporated by amendment into the Local Housing Assistance Plan (LHAP), the plan for the use of State Housing Initiative Partnership (SHIP) funds. F.S. 420.9076 and Chapter 67-37.010 (Exhibit I) requires a triennial review of the Plan and the impact of local policies, procedures, regulations, ordinances, and the comprehensive plan by the Affordable Housing Advisory Committee (AHAC). The Plan must "recommend specific actions or initiatives to encourage or facilitate affordable housing while protecting the ability of the property to appreciate in value." The triennial review must be presented to the local jurisdiction by December 31 in the year prior to submission of a new LHAP.

The AHAC has met regularly to review the County and City of Pensacola incentive strategies and evaluate the implementation of the plans for both jurisdictions. The Report (Exhibit II) includes recommendations or a status report regarding each of the eleven incentive strategies specifically mentioned in the Florida Statutes. No changes were recommended for the majority of the strategies. However, the AHAC did recommend including a section on building permits to note SHIP, CDBG, or HOME affordable housing projects (Incentive A), drafting a letter to ECUA requesting a waiver or reduction in impact fees for affordable housing projects (Incentive B), and reviewing the County's list of real properties to set aside properties suitable for affordable housing for approval by the Board (Incentive J).

On November 10, the AHAC held a public hearing (Exhibit III) and voted to approve the attached Report to be provided to the County Commission (as well as a separate report for the City of Pensacola). Completion of the review process and acceptance of the Report by the local jurisdictions is a requirement for the continued receipt of SHIP funds by the County and the City by the State.
BUDGETARY IMPACT:
Submission of the report by December 31, 2015 to the local jurisdiction is required for continued funding of the SHIP Program by Florida Housing Finance Corporation.

POLICY/REQUIREMENT FOR BOARD ACTION:
Chapter 67-37.010, FAC provides that local jurisdictions must receive the Affordable Housing Incentive Report prepared by the AHAC by December 31. The Board may choose whether or not to implement the recommendations.
IMPLEMENTATION/COORDINATION:
The acknowledgement of the report's receipt as signed by the County Administrator will be submitted to Florida Housing Finance Corporation as required.
