RECOMMENDATION:
Recommendation Concerning the State of Florida Department of Transportation Retailer Agreement (SunPass) - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the State of Florida Department of Transportation Retailer Agreement (SunPass) between the State of Florida Department of Transportation and Escambia County, Florida:

A. Approve and authorize the County Administrator, or designee, to sign the Retailer Agreement establishing Escambia County as an official SunPass Retailer; and

B. Authorize the County Administrator, or designee, to grant permission to Escambia County Public Works staff to acquire the necessary amount of SunPass decals from the Florida Department of Transportation on an as-needed basis for resale to customers desiring to become SunPass account holders for use at the Bob Sikes Bridge Toll Plaza, as well as all other toll facilities with SunPass interoperability.

BACKGROUND:
Escambia County Public Works staff requests that the Board of County Commissioners enter into the Retailer Agreement with the Florida Department of Transportation (FDOT) establishing Escambia County as an official SunPass Retailer.

Over the years of the Bob Sikes Bridge Toll Plaza operations, Escambia County and/or SRIA staff have sold either transponders or sticker decals to individuals, companies, organizations, etc. for the use of the Annual Pass Program. However, due to the conversion of the current Toll System to the SunPass System, the old transponder/sticker decal system will no longer be used, and will be replaced with the SunPass Decal System.  

This Agreement will allow County staff to sell SunPass decals (both portable and permanent decals) at the same location (Santa Rosa Island Authority [SRIA] Office Building) where the transponders/sticker decals have been sold in years past. The annual pass holders are accustomed to renewing or purchasing new annual passes at this location, so the ability to sell the SunPass decals there will allow the customers the option to purchase on-site rather than going to another SunPass retail location to purchase the decal.

It should be noted that Paragraph 11, titled Governing Law, Section A) specifically states "This Agreement shall be governed by and construed in accordance with the laws of the State of Florida and venue for any claims or disputes arising out of this Agreement shall be in Leon County, Florida."
BUDGETARY IMPACT:
Funding is available in Fund 167, Bob Sikes Toll Fund.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Agreement has been reviewed and approved for legal sufficiency by Kristin Hual, Assistant County Attorney.
PERSONNEL:
No additional personnel are anticipated for this action.

IMPLEMENTATION/COORDINATION:
Upon approval, Escambia County Public Works staff will coordinate with Florida Turnpike Enterprises on the purchase of SunPass decals.
