RECOMMENDATION:
Recommendation Concerning the Department of the Army Right of Entry for Environmental Assessment and Response on County-Owned Property at Ellyson Field - Tonya Gant, Neighborhood & Human Services Department Director

That the Board take the following action concerning the Department of the Army Right of Entry for Environmental Assessment and Response on County-owned Property at Ellyson Field:

A. Approve the Department of the Army Right of Entry for Environmental Assessment and Response Agreement for County-owned property located at Ellyson Field; and 

B. Authorize the Chairman to sign all documents related to the project.

BACKGROUND:
Ellyson Field was commissioned by the US Navy in 1941 as an auxiliary Field for the Pensacola Naval Air Station. In 1979 the Navy declared the entire site and improvements in excess and in 1981 the General Services Administration (GSA) conveyed the entire facility to the Pensacola-Escambia Promotion & Development Commission, a public corporation. Most of the parcels have been sold to private interests and Escambia County has retained several parcels. In 1994 the U.S. Army Corps of Engineers (USACOE) conducted an Inventory Project Report (INPR) for Containerized Hazardous ,Toxic, and Radioactive Waste (Con/HTRW), project number 104FL098101. This report identified multiple USTs and soil contamination for remediation. The USACOE is the the responsible party for all environmental assessment and cleanup under the project CON/HTRW project #104FL098101. This Right of Entry agreement grants the USACOE permission to access County property at Ellyson Field to conduct the ongoing the environmental site assessment.
BUDGETARY IMPACT:
There will be no budgetary impact. 
LEGAL CONSIDERATIONS/SIGN-OFF:
The Right of Entry has been reviewed by County Legal Department and approved to form and legal sufficiency. 
PERSONNEL:
No Additional Personnel required for this Project.  
POLICY/REQUIREMENT FOR BOARD ACTION:
The Right of Entry involving County property requires Board approval. 
IMPLEMENTATION/COORDINATION:
Neighborhood and Human Services Department/Community Redevelopment Agency staff will coordinate all functions required for this project.
