Issue:    Acceptance of a Portion of Real Property for "E" Street ADA Sidewalk Upgrades and Drainage Improvements

RECOMMENDATION:
Recommendation Concerning Acceptance of the Donation of a Portion of Real Property for "E" Street ADA Sidewalk Upgrades and Drainage Improvements - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning acceptance of the donation of a portion of real property located in the 2800 block of North "E" Street at the southeast corner of the intersection of "E" Street and Leonard Street, for Americans with Disabilities Act (ADA) sidewalk upgrades and drainage improvements:

A. Accept the donation of a portion of real property containing 155 square feet, located in the 2800 block of North "E" Street at the southeast corner of the intersection of "E" Street and Leonard Street from Athena Acoff, for ADA sidewalk upgrades and drainage improvements;                                 
                                                     
B. Authorize the payment of documentary stamps because the property is being donated for governmental use, which is for sidewalk and drainage improvements, and the County benefits from the acceptance of this property, which enhances the safety and well-being of the citizens of Escambia County;

C. Authorize the payment of incidental expenditures associated with the recording of documents; and

D. Authorize staff to prepare, and the Chairman or Vice Chairman to accept, the Warranty Deed as of the day of delivery of the Warranty Deed to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

BACKGROUND:

The "E" Street ADA Sidewalk Upgrade and Drainage Improvement Project is part of the Neighborhood Enhancement Program, which involves the reconstruction of sidewalks,ramps, pedestrian access upgrades (push buttons, signals, crosswalks, etc.), and incidental drainage improvements in the area of reconstruction. Improvements will be made on "E" Street at the intersections of Jordan Street and Leonard Street. Ms. Athena Acoff has agreed to donate 155 square foot of property needed to facilitate the construction of this project. 

Board approval is required for acceptance of the donated property.

BUDGETARY IMPACT:
Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by Escambia County Clerk's Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Warranty Deed was approved as to form and legal sufficiency by Stephen West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will proceed in compliance with Section 46-139 of the County Code of Ordinances.
