↵Recommendation Concerning the Interlocal Agreement with Escambia County During Emergency to Designate Alternate Facility - Will Moore, Trial Court Administration Administrative Services Manager

That the Board take the following action concerning the Interlocal Agreement with Escambia County relating to designating an alternate facility during emergency:

A. Approve the Interlocal Agreement between Escambia County and the State of Florida, First Judicial Circuit Court Administration Relating to the Designation of an Alternate Facility, the Pensacola Bay Center, for Court Proceedings; and

B. Authorize the County Administrator to sign the Interlocal Agreement.

BACKGROUND:

It has been determined from historical disaster response activities that a need exists for an alternative Court facility. The purpose of this agreement is to set forth the terms and conditions whereby the Pensacola Bay Center may be utilized by court personnel to conduct court proceedings during such time as the current court facility is deemed uninhabitable due to a declared state of emergency or other natural disaster.

BUDGETARY IMPACT:

The Court will reimburse the Facility on a monthly basis for use of all meeting spaces and for lost revenue incurred while Court is using the Facility. Fees charged will be at the current rate at the time of usage, and be less of tax.

LEGAL CONSIDERATIONS/SIGN-OFF:

Meredith D. Crawford, Assistant County Attorney, reviewed and approved the Interlocal Agreement as to form and legal sufficiency.

POLICY/REQUIREMENT FOR BOARD ACTION:

Board policy requires Board approval of all Interlocal Agreements.

IMPLEMENTATION/COORDINATION:

Upon Board approval and after an emergency, Court staff will coordinate with the Facility to complete all implementation requirements for this Interlocal Agreement.
