Issue:    Acceptance of a Drainage Easement from U.I.L. Family Limited Partnership

RECOMMENDATION:
Recommendation Concerning the Acceptance of a Drainage Easement from U.I.L Family Limited Partnership, for the Coral Creek Drainage Project - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the acceptance of the donation of a drainage easement (approximately 0.18 acres), located in the 2100 Block of Dog Track Road, from U.I.L. Family Limited Partnership, for the Coral Creek Drainage Project:

A. Accept the donation of a 0.18 acre drainage easement located in the 2100 Block of Dog Track Road, from U.I.L. Family Limited Partnership, for the Coral Creek Drainage Project;

B. Authorize the payment of documentary stamps as the drainage easement is being donated for governmental use, which is for drainage improvements, and the County benefits from the acceptance of this drainage easement, which enhances the safety and well-being of the citizens of Escambia County;
 
C. Authorize the payment of incidental expenditures associated with the recording of documents; and

D. Authorize staff to prepare, and the Chairman or Vice Chairman to accept the Drainage Easement as of the day of delivery of the Drainage Easement to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

BACKGROUND:
The county has a project in design to make stormwater drainage improvements in the area of Coral Creek Subdivision located off South Blue Angel Parkway. U.I.L. Family Limited Partnership, the owner of the property where the easement is required, has agreed to donate a Drainage Easement (approximately 0.18 acres) to the county to help facilitate the proposed improvements for Coral Creek Subdivision. U.I.L. Family Limited Partnership's property is located in the 2100 Block of Dog Track Road.  

This project is currently at 100% design and is ready to bid.  The schedule and completion date is dependent upon receiving the second easement from the adjoining parcel to the south.

Board approval is required for the Board's acceptance of the donated Drainage Easement.
BUDGETARY IMPACT:

Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by the Escambia County Clerk's office.

LEGAL CONSIDERATIONS/SIGN-OFF:
The Drainage Easement was approved as to form and legal sufficiency by Stephen West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will proceed in compliance with Section 46-139 of the County Codes.
