RECOMMENDATION:
Recommendation Concerning the State of Florida Department of Transportation Emergency Local Government Emergency Relief Reimbursement Agreement - South Old Corry Field Road (County Road 295A), FPID #436259-2-G8-01 - Joy D. Blackmon, P.E., Public Works Department Director
 
That the Board take the following action:

A. Rescind its action of January 8, 2015, approving the State of Florida Department of Transportation (FDOT) Emergency Local Government Emergency Relief Reimbursement Agreement for Old Corry Field Road (County Road 295A), for temporary repairs for this project; rescind its action adopting a Resolution (R2015-3) supporting the State of Florida Department  of Transportation Emergency Local Government Emergency Reimbursement Agreement, and rescind its action authorizing the Chairman to sign the Resolution, the Agreement, and any other documents associate with this Agreement.

B. Approve the State of Florida Department of Transportation Emergency Local Government Emergency Relief Reimbursement Agreement for South Old Corry Field Road (County Road 295A), FPID #436259-2-G8-01, subject to Legal sign-off, in the amount of $174,460, for repairs for this Project. 

C. Adopt the Resolution, subject to Legal sign-off, supporting the State of Florida Department of Transportation Emergency Local Government Emergency Reimbursement Agreement for South Old Corry Field Road (County Road 295A), FPID #436259-2-G8-01; and 

D. Authorize the Chairman to sign the Resolution, the Agreement, and any other documents associated with this Agreement.

BACKGROUND:
The Federal Highway Administration (FHWA) has established an Emergency Relief Program as a result of the Executive Order 14-144 dated April 30, 2014, for the Spring Storm April 2014 emergency event. Funding will be provided to the Florida Department of Transportation (FDOT) for relief from the damage inflicted by this event. This Emergency Relief Program Agreement provides for reimbursement to Escambia County for emergency relief. 

Escambia County has incurred costs and expenses as a direct result of this event (see attached Detailed Damage Inspection Report (DDIR). It has been determined that emergency repairs are necessary and that the costs and expenses of said repairs are eligible for reimbursement up to 80%, dependent on the amount of allocation made by FHWA. 

Adoption of the Resolution and approval of the Agreement will allow Escambia County to be reimbursed from FDOT's Emergency Relief Program in an amount not to exceed $174,460.00 for temporary repairs due to the Spring Storm April 2014 emergency event. 
 
Permanent repairs require design, planning, and relocation of existing utilities, which will take approximately 18 months to execute. Escambia County will request funding for permanent repairs from FHWA through FDOT’s Local Agency Partnership (LAP) process. Staff will present that to the Board, under separate cover, prior to permanent repair activities.

LEGAL CONSIDERATIONS/SIGN-OFF:
The Emergency Local Government Emergency Relief Reimbursement Agreement and Resolution has been forwarded to Kristin Hual, Assistant County Attorney, for review and sign-off with the inclusion of a notation that there is a provision in the Agreement stating that Escambia County consents to the venue of any Florida county chosen by the Department upon the Department filing a motion requesting same.

IMPLEMENTATION/COORDINATION:
Upon approval of this Recommendation, the Chairman will need to sign the Resolutions and three original copies of the State of Florida Department of Transportation Emergency Local Government Emergency Relief Reimbursement Agreement. The Clerk's Office will then need to certify three copies of the Resolutions for each package for FDOT, and retain the original for the official records. Public Works Department staff will forward the three signed original copies of the Agreements and three certified copies of the Resolutions to FDOT for final signatures and for their files for each package
