RECOMMENDATION: |
Recommendation Concerning the Escambia County Artificial Reef Construction 2015 Grant Agreement with Florida Fish and Wildlife Conservation Commission (FWC 14327) for the Tugboat "Ocean Wind" - Keith T. Wilkins, Community & Environment Department Director
That the Board take the following action concerning the Escambia County Artificial Reef Construction 2015 Grant Agreement with Florida Fish and Conservation Commission (FWC) for the tugboat "Ocean Wind":
A. Approve, subject to Legal sign-off, the Escambia County Artificial Reef Construction 2015 Grant Agreement between FWC and Escambia County (FWC Agreement No.14327) for the tugboat "Ocean Wind", in the amount not-to-exceed $100,000, from the date of execution through December 31, 2015. (Please note the last sentence of Agreement in Paragraph 34, “Any action in connection herewith, in law or equity, shall be brought in Leon County, Florida, to the exclusion of all other lawful venues.”; and Paragraph 36, Jury Trial Waiver.);
B. Authorize the Chairman to sign the Agreement; and
C. Authorize the Chairman to sign any subsequent Grant-related documents, including no-cost extensions, pending Legal review and approval, without further action of the Board.

BACKGROUND: |
Escambia County has been awarded a grant not to exceed $100,000 for the construction of an artificial reef by cleaning, preparing, and deployment of the tugboat Ocean Wind in the Gulf of Mexico approximately eight miles south of Escambia County, Florida. |

LEGAL CONSIDERATIONS/SIGN-OFF: |
A draft of the Grant Agreement has been reviewed by Kristin Hual, Assistant County Attorney. The Community & Environment Department is awaiting hard copy originals to be distributed under separate cover after Legal review and sign-off. |
PERSONNEL: |
No additional personnel are required to implement this Grant Agreement. |
POLICY/REQUIREMENT FOR BOARD ACTION: |
Board policy requires approval of all contracts as well as those in excess of $50,000. This recommendation is consistent with the County’s commitment to fiscal responsibility and cost efficiency. |
IMPLEMENTATION/COORDINATION: |
The Community & Environment Department, Marine Resources Division, will continue coordinating with FWC on all activities associated with the Grant Agreement. |
