RECOMMENDATION:
Recommendation Concerning Choctaw Outfall Drainage Improvements - Stephan Hall, Management and Budget Services Interim Department Director

That the Board award Contract PD 14-15.021, for Choctaw Outfall Drainage Improvements, to Brown Construction of Northwest Florida, Inc., in the amount of $97,958.90.

BACKGROUND:
The Invitation to Bid PD 14-15.021 was advertised in the Pensacola News Journal on December 29, 2014, and January 5, 2015.  Eighteen firms were notified on December 29, 2014.  Eleven firms picked up the plans and specifications for the bid from the Office of Purchasing.  A total of six bids were received on January 27, 2015.  Brown Construction of Northwest Florida, Inc. is the low bidder. The original construction of the outfall system for Choctaw Avenue was completed in December 2012. During plan development, the scope of construction was expanded due to mediation requirements which resulted from an eminent domain process. After construction closeout and in accordance with the mediation documentation, the property owner and his legal team received a copy of all as-built information for review. The legal team of the property owner has challenged the County and the court has ruled that some aspects of the improvements were not constructed exactly per plan; therefore a portion of the system will need to be reconstructed.  Although the system is functioning as intended and the engineer of record has approved it; the court does not recognize construction variances and will require reconstruction. The scope of the project consists of removal and reinstallation of pipes and the removal and replacement of existing endwall and splash pad.

IMPLEMENTATION/COORDINATION:
The Office of Purchasing will issue the Purchase Order and distribute the Contract.
