RECOMMENDATION:
Recommendation Concerning the Acceptance of a Stormwater Drainage Easement from Cypress Point East and West Homeowners Association, Inc. - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the acceptance of the donation of a Stormwater Drainage Easement (approximately 0.57 acres), located on Scenic Highway, from Cypress Point East and West Homeowners Association, Inc.:

A. Accept the donation of a 0.57 acre stormwater drainage easement located on Scenic Highway, from Cypress Point East and West Homeowners Association, Inc.;

B. Authorize the payment of documentary stamps as the stormwater drainage easement is being donated for governmental use, which is for drainage improvements, and the County benefits from the acceptance of this stormwater drainage easement, which enhances the safety and well-being of the citizens of Escambia County;
 
C. Authorize the payment of incidental expenditures associated with the recording of documents; and

D. Authorize staff to prepare, and the Chairman or Vice Chairman to accept the Stormwater Drainage Easement as of the day of delivery of the Stormwater Drainage Easement to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

BACKGROUND:
Meeting in regular session on June 26, 2014, the Board of County Commissioners included the Glynn Broc Gully project as one of several projects submitted to the United States Department of Agriculture (USDA) Natural Resources Conservation Service (NRCS) Emergency Watershed Project (EWP) Agreement Program. As a result of the April flooding event, Glynn Broc Gully received a large amount of erosion and sediment build up.

The county has a project in design to make stormwater drainage improvements in the area of Cypress Point Subdivision and Glynn Broc Gully, located off Scenic Highway. Cypress Point East and West Homeowners Association, Inc., the owner of the property where Glynn Broc Gully is located, has agreed to donate a Drainage Easement (approximately 0.57 acres) to the county to help facilitate the proposed improvements and removal of sediment from the Cypress Point Channel as part of the Glynn Broc Gully EWP-NRCS restoration project.

Board approval is required for the Board's acceptance of the donated drainage easement.
BUDGETARY IMPACT:

Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by the Escambia County Clerk's office.

LEGAL CONSIDERATIONS/SIGN-OFF:
The Drainage Easement was approved as to form and legal sufficiency by Stephen West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will proceed in compliance with Section 46-139 of the County Codes.
