RECOMMENDATION:
Recommendation Concerning the Amendment to the Special Needs Housing for Persons with Developmental Disabilities Agreement - Keith T. Wilkins, Community & Environment Department Director 

That the Board take the following action concerning the Amendment to the Special Needs Housing for Persons with Developmental Disabilities Agreement with ARC Gateway, Inc. (ARC), funded through the State Housing Initiatives Partnership (SHIP) Program:

A. Approve an Amendment to the Agreement with ARC Gateway, Inc., joining Pollak Rehabilitation Center, Inc., as a party to the Agreement; and

B. Authorize the Chairman or Vice Chairman to execute the Amendment.
BACKGROUND:
On December 5, 2013, the Board approved an Agreement with ARC providing for 2014 State Housing Initiatives Partnership (SHIP) Program funding in the amount of $113,786 to rehabilitate five properties for special needs housing (Exhibit I). The rehabilitation of the properties was completed in September 2014 and is occupied by low income developmentally disabled clients as specified in the Agreement.

ARC has requested an Amendment (Exhibit II) to the original Agreement to recognize that title to the properties is held by Pollak Rehabilitation Center, Inc. (Pollak). Pollak is a registered not-for-profit (Exhibit III) controlled by ARC that is set up to hold ARC's real property. This requested transfer does not change the original Agreement in any other manner as the properties will continue to serve the same targeted clientele during the prescribed affordability period.
BUDGETARY IMPACT:
N/A. Funds have already been expended for this project.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Amendment has been reviewed and approved by Stephen West, Assistant County Attorney. ARC and Pollak have also reviewed the subject Amendment.
PERSONNEL:
N/A.
POLICY/REQUIREMENT FOR BOARD ACTION:
This Amendment approval is required to join Pollak as a party to the original Agreement to ensure continued compliance with the long-term affordability of the housing and clients to be served.
IMPLEMENTATION/COORDINATION:
N/A. Project compliance will continue to be monitored by Neighborhood Enterprise Division.
