RECOMMENDATION:
Recommendation Concerning the Conveyance of Easement to and License Agreement with the Florida Department of Transportation for the State Road 10 (US 90A/Nine Mile Road) Improvement Project - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the conveyance of a Perpetual Easement to the State of Florida Department of Transportation (FDOT) and License Agreement between Escambia County and FDOT, for their planned improvement project for the portion of State Road (SR) 10 (US 90A/Nine Mile Road), from SR 297 (Pine Forest Road) to SR 95 (US 29):

A. Adopt the Resolution authorizing the conveyance of a Perpetual Easement to FDOT for their planned improvement project for the portion of SR 10 (US 90A/Nine Mile Road), from SR 297 (Pine Forest Road) to SR 95 (US 29);

B. Approve the License Agreement between Escambia County and the State of Florida Department of Transportation for their planned improvement project for the portion of SR 10 (US 90A/Nine Mile Road), from SR 297 (Pine Forest Road) to SR 95 (US 29); and

C. Authorize the Chairman to execute the Easement, Resolution, License Agreement and all other documents related to the conveyance, subject to Legal review and sign-off, without further action of the Board.
BACKGROUND:
The Florida Department of Transportation (FDOT) has a project designed for multi-lane construction and roadway and drainage improvements to State Road (SR) 10 (US 90A/Nine Mile Road) from SR 297 (Pine Forest Road) to SR 95 (US 29). FDOT is requesting that the County convey a Perpetual Easement and License Agreement to facilitate their project. The license agreement is for work to be performed where various County road rights-of-way intersect with Nine Mile Road. The perpetual easement is for stormwater drainage work to be performed along Untreiner Avenue right-of-way. FDOT will be responsible for all costs associated with this request, including the recording of documents.  

Staff has reviewed this request and determined that the conveyance of this easement and license agreement will have no adverse impact to the County and have no objections to the conveyance of the easement and license agreement.
BUDGETARY IMPACT:
All costs associated with accepting and recording of documents will be borne by FDOT.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Easement, Resolution and License Agreement were approved as to form and legal sufficiency by Stephen West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, Staff will maintain compliance with Section 46-139 of the Escambia County Code of Ordinances.
