RECOMMENDATION:
Recommendation Concerning a Locally Funded Agreement to support the Installation of Conduit, Anchor Bolts, and Pull Boxes on CR292A Sunset Avenue Bayou  Grande Bridge, Bridge No. 484245 (Project#430003-1-52-03)- Keith Wilkins, Department Director

That the Board take the following action concerning the Installation of Conduit, Anchor Bolts, and Pull Boxes (for future light poles) and Class 5 Finish Surface on CR292A Sunset Avenue Bayou Grande Bridge, Bridge No. 484245 (Project#430003-1-52-03) in Escambia County:

A. Adopt the Resolution supporting the installation of conduit, anchor bolts, and pull boxes (for future light poles) and Class 5 Finish Surface on CR292A Sunset Avenue Bayou Grande Bridge, Bridge No. 484245 (Project#430003-1-52-03);

B. Approve the Locally Funded Agreement (LFA) between the State of Florida Department of Transportation (FDOT) and Escambia County, Project #430003-1-52-03; and

C. Authorize the Chairman to sign the Resolution and Local Funding Agreement.

BACKGROUND:
Escambia County and FDOT have determined it is in the best interest of all concerned  to install conduit, anchor bolts, and pull boxes (for future light poles), and Class 5 Finish Surface on CR292A Sunset Avenue Bayou Grande Bridge, Bridge No. 484245, in Escambia County (Project#430003-1-52-03) in conjunction with the replacement of the bridge (#430003-1-52-01). 

The County Attorney's Office has these concerns which are:

1) This Agreement requires the County to make an advance deposit in the amount of the estimated cost;
2) There is no provision for capping the County's funding obligation; and
3) There is no provision requiring mutual agreement for any budget increases. 
BUDGETARY IMPACT:
Funds for this project are available in Fund Fund 151, CRA Warrington TIF, Cost Center 220516. 

Escambia County will, within fourteen calendar days of the execution of this Agreement, furnish FDOT an advance deposit in the amount of $42,384.00 for full payment of the County’s share of the estimated project costs.  FDOT and the County agree that this payment constitutes a full and final payment for the County's share of the cost of the work on Project #430003-1-52-03.


LEGAL CONSIDERATIONS/SIGN-OFF:
County Attorney's office have reviewed and approved  the Locally Funded Agreement between the State of Florida Department of Transportation and Escambia County for Project #430003-1-52-03, and the Resolution as to form and legal sufficiency with the understanding that they do have some concerns and would like these brought up for discussion.

IMPLEMENTATION/COORDINATION:
Upon the Board’s approval of this Recommendation, the Chairman will need to sign five original copies of the Locally Funded Agreement. The Clerk’s office will then need to certify five copies of the Resolution for FDOT and retain the original for the official records. Community Redevelopment Agency (CRA) staff will forward the five signed original copies of the Agreement and the five certified copies of the Resolution to FDOT for final signatures and for their files.  The Clerk's office will furnish FDOT with a check in the amount of $42,384 within fourteen calendar days of this Agreement.
