RECOMMENDATION:
Recommendation Concerning Final Plat for Bentley Oaks Unit 4, Phase 1 PSD130300004 

That the Board take the following action concerning the recording of the Final Plat of Bentley Oaks, Unit 4, Phase 1 (a 41 lot single-family residential subdivision with public streets and private Parcel G-1 a temporary access road and Parcel G-2 known as Mica Drive and including a 15 ft wide public utility easement lying within said Parcels G-1 and G-2).  Located in Farm Hill, a Cantonment community, lying north of West Kingsfield Road and west of Highway 297A. Owned and developed by Beaird Development, LLC.  Prior to recording, the County Engineer, County Surveyor, Development Services Interim Director and the Clerk of the Circuit Court must sign the Final Plat, as set forth in Section 4.02.07.E, of the Escambia County Land Development Code.  Also, prior to recording the County Surveyor must sign the Final Plat as set forth in Chapter 177.081 (1) Florida Statute;
 
A.       Approve the final plat for recording; and
 
B.       Approve the street names “Avalon Street, Slate Drive, Quartz Avenue and Mica Drive; and
 
C.       Accept all public easements, drainage improvements within public easements/public parcels as depicted upon the final plat for permanent County maintenance, the cost of pond maintenance is to be funded through the establishment of a storm water management MSBU (Municipal Services Benefit Unit).
BACKGROUND:
The Preliminary Plat and Construction Plans were approved on October 9, 2013.  The Escambia County Public Safety Department approved the street names “Avalon Street, Slate Drive, Quartz Avenue and Mica Drive” on June 21, 2006.  Development Services Department inspected the improvements on November 21, 2014 and found improvements substantially complete and in accordance with applicable County Requirements.  A Two-Year Warranty Agreement without Surety, Hold Harmless, and Indemnification Agreement are to be recorded with the plat. Staff has reviewed the final plat.
LEGAL CONSIDERATIONS/SIGN-OFF:
This recommendation is consistent with previous practices of the County Attorney’s Office. The Two-Year Warranty Agreement For Streets and Drainage Improvements without Surety, Hold Harmless, and Indemnification Agreement were reviewed and approved by Steve West on November 6, 2014. Also, this office has concerns regarding Parcel G-1 a private temporary access road and private Parcel G-2, Mica Drive as addressed in an email and being included as an attachment with this recommendation.
PERSONNEL:
All work associated with this recommendation was done in-house and no additional staff was required. Future Road Department budgets will reflect additional cost to maintain these improvements.
POLICY/REQUIREMENT FOR BOARD ACTION:
Based on the Escambia County Land Development Code – providing procurement for surety to warrant subdivision improvements (Ord. #2002-9) and the Florida State Plat Act - Chapter 177.
IMPLEMENTATION REQUIREMENTS:
Once the final plat has been approved by the Board and final sign-offs given by the County Engineer, County Surveyor and Development Services Interim Director, the final plat shall be transmitted to the Clerk of Court’s Office for recording in the public records of Escambia County, Florida.
COORDINATION WITH OTHER AGENCIES/PERSONS:
Staff has been in contact with the developer’s engineer/surveyor, County Road Department, County Building Inspections and Development Services Department.
