RECOMMENDATION:
November 3, 2014, communication from Jackie Rozier requesting that the Board provide relief of Code Enforcement Lien against property located at 201 Edison Drive.
 
Recommendation: That the Board review and consider lien relief request made by Jackie Rozier against property located at 201 Edison Drive.
 
On June 18, 2009, the Board amended the “Guidelines for Relief from Environmental (Code) Enforcement Special Magistrate Liens” Policy, Section III, H 2.  Staff was instructed to review all requests for forgiveness of Environmental (Code) Enforcement Liens to determine if the requests met the criteria for forgiveness, in accordance with the Board’s policy.
 
After reviewing the request for forgiveness of Liens, staff made the determination that the request does not fall within any of the criteria that would allow the County Administrator to deny relief, in accordance with the Board’s Policy, “Guidelines for Relief from Environmental (Code) Enforcement Special Magistrate Liens” Policy, Section III, H2.
 
NOTE: These liens are hard costs only.
BACKGROUND:

The Office of Environmental Enforcement received a complaint for overgrowth, trash and debris. Officer investigated the complaint and found property to be in violation. A Notice of Violation was posted at property and a copy was mailed both regular and certified mail. Notice of Violation was received but unable to read signature.
 
Officer Davis reinspected the property on August 24, 2011 and found the property to remain in violation. Case was referred for Summary Abatement.
 
Officer Reber, Abatement Officer, conducted her pre-bid inspection on September 22, 2011 and observed violations remain.Escambia County abated violations on October 27, 2011 in the amount of $275.00.

The Office of Environmental Enforcement received a complaint for overgrowth, trash, debris and unsafe structure. Officer investigated complaint and observed violations. A Notice of Violation was posted at property and a copy was mailed both regular and certified mailed. Certified Notice was returned marked “Unclaimed”. Officer also posted a copy of the notice at owner’s residence.
 
June 14, 2012 Officer Davis conducted his reinspection and observed violations remain. He request a title search in preparation for court.
 
August 30, 2012 a Lis Pendens was filed. Officer Davis mailed a Notice of Violation to the bank.
 
Officer David conducted his reinspection on September 5, 2012 and observed violations remain. He then requested a hearing date.
 
Hearing Notices were mailed to both owner and bank. Both Notices were received.
 
Hearing was held on November 6, 2012. Escambia County was awarded $1,100.00 court cost, $50.00 per day fine with a deadline of December 10, 2012 to abate violations. A copy of the Order was mailed to both owner and bank.
 
Officer Davis conducted his follow up inspection on December 10, 2012 and observed all violations abated by the owner.
