RECOMMENDATION:
Recommendation Concerning the Conveyance of Real Property and Easements to the Florida Department of Transportation for the State Road 95 (U.S. 29) Improvement Project - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the conveyance of real property and easements of varying widths, to the Florida Department of Transportation (FDOT), for their planned improvement project for the portion of State Road 95 (U.S. 29), from Interstate 10 (I-10) to 9 1/2 Mile Road:

A. Adopt the Resolutions authorizing the conveyances of real property and easements of varying widths, to FDOT, for their planned improvement project for the portion of State Road 95 (U.S. 29), from Interstate 10 (I-10) to 91/2 Mile Road; and

B. Authorize the Chairman to execute the Deeds, Easements, Resolutions, and all other documents, subject to Legal review and sign-off, related to the conveyances, without further action of the Board.
BACKGROUND:
The Florida Department of Transportation (FDOT) has a project designed for multi-lane construction and roadway and drainage improvements to State Road 95 (U.S. 29) from I-10 to 9 1/2 Mile Road. FDOT is requesting that the County convey real property for a retention pond and rights-of-way and permanent and temporary easements to facilitate their project. FDOT will be responsible for all costs associated with this request, including the recording of documents.

 Staff has reviewed this request and determined that the conveyance of these properties and easements will have no adverse impact to the County and have no objections to the conveyance of the real property and easements.
BUDGETARY IMPACT:
All costs associated with accepting and recording of documents will be borne by FDOT.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Deeds, Easements and Resolutions were approved as to form and legal sufficiency by Stephen West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, Staff will maintain compliance with Section 46-139 of the Escambia County Code of Ordinances.
