RECOMMENDATION:
Recommendation Concerning the Scheduling of a Public Hearing to Consider the Petition to Vacate the Plat of Colonial Park Subdivision - Joy D. Blackmon, P. E., Public Works Department Director

That the Board authorize the scheduling of a Public Hearing for December 11, 2014, at 5:35 p.m., to consider the Petition to Vacate the plat of Colonial Park Subdivision, a commercial subdivision recorded in Plat Book 18, at Page 54, as petitioned by Levin Group, LLC.
BACKGROUND:
Colonial Park Subdivision is 6-lot private commercial subdivision located west of Pensacola Boulevard (U.S. Highway 29) and north of North "W" Street (County Road 453). Meeting in regular session on November 16, 2006, the Board approved for recording the final plat of Colonial Park Subdivision. The subdivision has not been developed and Levin Group, LLC, the owner of all the lots in the subdivision, is petitioning the Board of County Commissioners to consider the request to vacate the plat of Colonial Park Subdivision as recorded in Plat Book 18 at Page 54 of the public records of Escambia County, Florida. 

There are no encroachment issues involved with this vacation request. Staff has reviewed this request and has no objections to the proposed vacation. The petitioner has contacted all utility companies concerned and has an agreement with the utility companies to coordinate with them relative to any existing utilities. No one will be denied access to his or her property as a result of this vacation.
BUDGETARY IMPACT:

Indirect staff cost associated with the preparation of documents and recommendation.

LEGAL CONSIDERATIONS/SIGN-OFF:

N/A

PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:

This recommendation is based on the Board’s Subdivision Plat Vacation Procedures - Section III(A) and Florida Statutes, Chapter 177.

IMPLEMENTATION/COORDINATION:

Once the Public Hearing has been scheduled, the Petitioner will be notified, the date and time will be advertised, and all owners of property within 500 feet will be notified.

Staff has been in contact with Justin Beck (Beck Property Company, LLC), agent for the Petitioner. It is the responsibility of the Petitioner or the Petitioner's agent to advertise the Notice of Public Hearing.
