Issue:    Acceptance of Real Property for Killam Road Paving and Drainage Project

RECOMMENDATION:
Recommendation Concerning Acceptance of the Donation of Real Property for Killam Road Paving and Drainage Project - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning acceptance of the donation of real property, located at 8521 Killam Road, for the Killam Road Paving and Drainage Improvements Project:

A. Accept the donation of a parcel of real property (approximately 0.06 acres), located at 8521 Killam Road, for the Killam Road Paving and Drainage Improvements Project;                                 
                                                     
B. Authorize the payment of documentary stamps, because the property is being donated for governmental use, which is for road and drainage improvements, and the County benefits from the acceptance of this property, which enhances the safety and well-being of the citizens of Escambia County;

C. Authorize the payment of incidental expenditures associated with the recording of documents; and

D. Authorize staff to prepare, and the Chairman or Vice Chairman to accept the Warranty Deed as of the day of delivery of the Warranty Deed to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

BACKGROUND:
The County has a project in design to make road paving and drainage improvements on Killam Road, which is a County-maintained dirt road, located in the north portion of Escambia County. Due to limited right-of-way, it was determined that additional property would be required to facilitate the paving and drainage project. Mr. Mark Holland, owner of the property at 8521 Killam Road, has agreed to donate a portion of his property (approximately 0.06 acres), that fronts Killam Road, to facilitate the road paving and drainage improvements project. Board approval is required for the Board's acceptance of the donated property.

Once all property is acquired, the County will be able to finalize the design and bid the project for construction by the end of the calendar year.
BUDGETARY IMPACT:
Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by Escambia County Clerk's Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Warranty Deed was approved as to form and legal sufficiency by Stephen West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will proceed in compliance with Section 46-139 of the County Code of Ordinances.
