RECOMMENDATION:
Recommendation Concerning the Acceptance of a Drainage Easement Located on Bush Street - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the acceptance of the donation of a 10-foot-wide drainage easement located along the unimproved portion of Bush Street between Quail Road and Newcastle Subdivision, from Gulf Coast Community Bank:

A. Accept the donation of a 10-foot-wide drainage easement located along the unimproved portion of Bush Street between Quail Road and Newcastle Subdivision, from Gulf Coast Community Bank;

B. Authorize the payment of documentary stamps, as the easement is being donated for governmental use, such as for drainage improvements and for continuous maintenance of the existing drainage system along the roadway.  In addition, the County benefits from the acceptance of the easement, which enhances the safety and well-being of the citizens of Escambia County;
 
C. Authorize the payment of incidental expenditures associated with the recording of documents; and

D. Authorize staff to prepare, and the Chairman or Vice Chairman to accept the Drainage Easement as of the day of delivery of the Drainage Easement to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

BACKGROUND:
The County has an existing drainage system located along the unimproved portion of Bush Street from Quail Road east to Newcastle Subdivision. The system consists of a 30" pipe and related structures. The existing 10' wide easement located along this portion of Bush Street is not adequate for access to and maintenance of the system. 

Staff approached the owner of the property, Gulf Coast Community Bank, to request the donation of an additional 10' wide drainage easement, which would lie parallel and adjacent to the existing 10' wide easement. The owners have agreed to the donation of the drainage easement. Board approval is required for acceptance of the donated drainage easement.
BUDGETARY IMPACT:

Funds for incidental expenditures associated with the recording of documents are available in an Engineering Escrow Account accessed by the Escambia County Clerk's Office.

LEGAL CONSIDERATIONS/SIGN-OFF:
The Drainage Easement was approved as to form and legal sufficiency by Stephen West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will proceed in compliance with Section 46-139 of the County Codes.
