Recommendation Concerning the Third Party Escrow Agreement for the Locally-Funded Agreement Between the Florida Department of Transportation and Escambia County, Florida - Joy Jones, P.E., Engineering Department Director
That the Board take the following action concerning the Third Party Escrow Agreement for the Locally-Funded Agreement (LFA) between the Florida Department of Transportation (FDOT) and Escambia County, Florida:
A. Approve and authorize the Chairman to sign the Third Party Escrow Agreement between the FDOT and Escambia County, Florida, for County Road (CR) 4 over Canoe Creek (Bridge No. 480039) Bridge Replacement Project (Project #437699-1-32-01); and
B. Approve and authorize the Chairman to sign the Third Party Escrow Agreement between the FDOT and Escambia County, Florida, for Interstate Circle over 8 Mile Creek (Bridge No. 484071) Bridge Replacement Project (Project #442920-1-32-01).
The project for County Road 4 over Canoe Creek is located in Commission District 5; the project for Interstate Circle over 8 Mile Creek is located in Commission District 1.
BACKGROUND:
Meeting in regular session on June 4, 2020, the Board approved the following:
A. Locally-Funded Agreement between the FDOT and Escambia County, for County Road (CR) 4 over Canoe Creek (Bridge No. 480039) Bridge Replacement Project (Project #437699-1-32-01); and
B. Locally-Funded Agreement between the FDOT and Escambia County, for Interstate Circle over 8 Mile Creek (Bridge No. 484071) Bridge Replacement Project (Project #442920-1-32-01).
The Third Party Escrow Agreements were listed as an attachment in paragraph 12 of the Locally-Funded Agreement but the legal stamped/approved copies were not included in the backup.This Recommendation recognizes those Agreements for Board approval and for the Chairman's authorization to sign those Agreements.

LEGAL CONSIDERATIONS/SIGN-OFF:
The Third Party Escrow Agreements were reviewed and approved by the County Attorney's Office.
PERSONNEL:
No new personnel will be required.
POLICY/REQUIREMENT FOR BOARD ACTION:
Board policy requires Board approval of all Agreements.
IMPLEMENTATION/COORDINATION:
Upon approval, Engineering staff will transmit the two signed Third Party Escrow Agreements to FDOT for execution. Once executed, funds will be forwarded to FDOT for the project. Staff will continue to coordinate with FDOT as necessary.
