RECOMMENDATION:
Recommendation Concerning First Amendment to Contract for Sale and Purchase with Navy Federal Credit Union.
That the Board approve and authorize the Chairman to execute the First Amendment to Contract for Sale and Purchase with Navy Federal Credit Union.
BACKGROUND:
On May 16, 2019, the Board approved the Contract for Sale and Purchase with Navy Federal Credit Union (NFCU) for the sale and purchase of approximately 96 acres on the eastern portion of the NOLF-8. Section 4 of the contract allows NFCU a 60-day inspection period to conduct various tests, analyses, surveys and investigations to determine whether the property is suitable for NFCU's intended use. NFCU's environmental consultant, Terracon Consultants, Inc., recently discovered new RECs (Recognized Environmental Conditions) in the Phase I Environmental Site Assessment prepared for NFCU that were not included in Terracon's Environmental Baseline Survey, dated October 1, 2018, which was provided to the County in connection with the conveyance of the deed from the U.S. Navy. As such, NFCU requests to extend the inspection period through October 14, 2019 (75 days) to allow for further environmental review.
