RECOMMENDATION:
Recommendation Concerning the Acceptance of a Public Road and Right-of-Way Easement for Helms and Hidden Valley Roads - Joy Jones, P.E., Engineering Department Director
That the Board take the following action concerning the acceptance of the donation of a Public Road and Right-of-Way Easement (approximately 2 acres) located in the 6700 Block of Helms Road, abutting Hidden Valley Road, from Josh and Elizabeth Fulford:
A. Accept the donation of a Public Road and Right-of-Way Easement located in the 6700 Block of Helms Road, abutting Hidden Valley Road, for road improvements;
B. Authorize the payment of documentary stamps because the property is being donated for governmental use and the County benefits from the acceptance of this property, which enhances the safety and well-being of the citizens of Escambia County;
C. Authorize the payment of incidental expenditures associated with the recording of documents; and
D. Authorize the Chairman or Vice Chairman to accept the Easement as of the day of delivery of the Easement to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.
This property is located in Commission District 1.

BACKGROUND:
Josh and Elizabeth Fulford have obtained approval through the Development Review Committee for a minor subdivision located off Helms and Hidden Valley Roads, which are maintained by Escambia County. However, because the Fulfords have proposed to subdivide the parent parcel, the roads' rights-of-way must be brought to minimum standards, as they currently have insufficient width in some places. Mr. and Mrs. Fulford have agreed to donate the necessary property along Helms Road and Hidden Valley Road to bring these roads into compliance.
BUDGETARY IMPACT:
Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by the Escambia County Clerk's Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Public Road and Right-of-Way Easement was approved as to form and legal sufficiency by Stephen West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
Upon Board approval, county staff will proceed in compliance with Section 46-139 of the Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will have the executed Public Road and Right-of-Way Easement recorded in the public records of Escambia County, Florida.
