RECOMMENDATION:
Recommendation Concerning County Maintenance of Brookhaven Phase 1 - Joy Jones, P.E., Engineering Department Director

That the Board approve the cost of maintenance for the public stormwater system to be funded through the establishment of a Stormwater Management Municipal Services Benefit Unit (MSBU) for Brookhaven Phase 1 (a 133-lot residential subdivision) located in the Pine Forest community, lying north of Devine Farm Road and west of South Highway 97 (County Road 97).

This project is located in Commission District 5.
BACKGROUND:
The final plat of Brookhaven Phase 1 and the 2-Year Warranty Agreement with Surety and Irrevocable Letter of Credit was approved by the Board of County Commissioners on January 10, 2019. The 2-Year Warranty Agreement with Surety and Irrevocable Letter of Credit was recorded in the public records of Escambia County on January 17, 2019, at Official Records Book 8031, Pages 1806 thru 1813.

An item for establishing a stormwater management MSBU was inadvertently left off of the Final Plat recommendation to the Board at the regularly-scheduled meeting on January 10, 2019.
BUDGETARY IMPACT:
Future Public Works Department budgets will reflect additional costs to maintain these improvements as necessary.
LEGAL CONSIDERATIONS/SIGN-OFF:
This recommendation is consistent with previous practices of the County Attorney's Office.
PERSONNEL:
All work associated with this Recommendation was done in-house and no additional staff was required. Future Public Works Department budgets will reflect additional costs to maintain these improvements as necessary.
POLICY/REQUIREMENT FOR BOARD ACTION:
This action is based on Escambia County's stormwater MSBU Ordinance #2006-51, adopted by the Board of County Commissioners on July 20, 2006, under the authority of Florida Statutes 125.01. 
IMPLEMENTATION/COORDINATION:
The Office of Management & Budget will ensure property owners are assessed fairly and reasonably for the maintenance costs of ponds and drainage easements.
