RECOMMENDATION:
Recommendation Concerning the Scheduling of a Public Hearing to Consider the Vacation of a Portion of Unopened Right-of-Way Known as Hollyhill Road - Joy Jones, P.E., Engineering Department Director

That the Board take the following action regarding a Petition to Vacate a Portion of Unopened Right-of-Way known as Hollyhill Road, as petitioned by Patrick W. Corkill:

A. Authorize the scheduling of a Public Hearing for November 7, 2019, at  5:31 p.m., to consider the Petition to Vacate a Portion of Unopened Right-of-Way known as Hollyhill Road (0.14 acres, more or less), as petitioned by Patrick W. Corkill; and

B. Require the Petitioner to notify all property owners within a 500 foot radius.

The real property mentioned in this Petition to Vacate is located in Commission District 1.
BACKGROUND:
This portion of Hollyhill Road is a wooded unopened right-of-way. Petitioner owns a 12 foot wide x 382 foot long strip of land to the north of this portion of Hollyhill Road and also owns 0.68 acres, more or less south of Hollyhill Road. He is trying to vacate this portion of unopened right-of-way to make his property one continuous property. 

The west side of the area requested to be vacated is where Wymart Road/Interstate Circle and the improved portion of Hollyhill Road intersect. This improved portion of the County right-of-way has been maintained by the County for years. It would be ideal, if the petitioner would deed a corner clip section of his property to the County for the improved roadway area that is currently located on the west end of his property. The improved roadway is not located in the requested area to be vacated, however, the location of the improved roadway being on his property was noticed during the review of this request.

County Staff has reviewed this request and has no concerns with the vacation request. Public Safety supports the vacation if access to an existing fire hydrant on the west end ( Hollyhill at Wymart/Interstate Circle) is maintained. The peitioner has agreed, regardless of the vacation outcome, to quit claim the improved roadway area that has the fire hydrant to the County.

Utility companies have been notified. There are no facilities in the requested vacation area. However, Gulf Power has an anchor and guy wire on the corner clip of the Petitioner's property and Emerald Coast Utilities Authority (ECUA) stated that their water main is also located in the corner clip of the Petitioner's property.
BUDGETARY IMPACT:

Indirect staff cost associated with the preparation of documents and recommendation.

LEGAL CONSIDERATIONS/SIGN-OFF:

Not Applicable. 

PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:

Based on the Board’s Vacating, Abandoning, and Closing Existing Public Streets, Rights-of-Way, Alleyways, Roads, Highways, Other Places Used for Travel or Other Lands Dedicated for Public Use or Purposes, or Any Portions Thereof to Renounce and Disclaim Any Right of the County and The Public In and To Said Lands policy for closing, vacating and abandoning County owned property – Section III and Florida Statutes, Chapter 336.

IMPLEMENTATION/COORDINATION:

Once the Public Hearing has been scheduled, the Petitioner will be notified, the date and time will be advertised, and all owners of property within 500 feet will be notified.
