RECOMMENDATION:
5:31 p.m. Public Hearing for Consideration of Adopting an Ordinance Creating Volume 1, Chapter 94, Article 1, Section 94-9 relating to Micromobility Devices and Motorized Scooters on Pensacola Beach.

Recommendation: That the Board adopt and authorize the Chairman to sign the Ordinance regulating the operation of micromobility devices and motorized scooters on Pensacola Beach.
BACKGROUND:
Recent changes to the Florida Uniform Traffic Control Law allow Counties to enact Ordinances to permit, control, or regulate the operation of vehicles, golf carts, mopeds, motorized scooters, and other mobility devices on sidewalks or sidewalk areas, so long as certain requirements are met. The Santa Rosa Island Authority requested the Board of County Commissioners enact an Ordinance governing the use and operation of micromobility devices and motorized scooters on Pensacola Beach. County Attorney staff drafted this Ordinance, which regulates the operation of such devices on Pensacola Beach. This Ordinance was presented, discussed, and approved during Santa Rosa Island Authority Committee and Board meetings in May and June 2020. Subsection 2.(6)c. regarding geofencing was added after the Santa Rosa Island Authority approved the proposed Ordinance.

LEGAL CONSIDERATIONS/SIGN-OFF:
The proposed Ordinance was drafted by Matthew R. Shaud, Assistant County Attorney, and was advertised in the Pensacola News Journal on Saturday, July 25, 2020.

POLICY/REQUIREMENT FOR BOARD ACTION:
The proposed Ordinance is consistent with the Board's goal to ensure the health, safety, and welfare of the citizens of Escambia County.
IMPLEMENTATION/COORDINATION:
Upon Board approval, the County Attorney's Office will work with the Clerk of the Circuit Court's Office to ensure the Ordinance is filed with the State.
