RECOMMENDATION:
Recommendation Concerning the Permission to Enter Property - Non-Source Agreement with State of Florida, Department of Environmental Protection, for the Former Omni-Vest Landfill - J. Taylor "Chips" Kirschenfeld, Director, Department of Natural Resources Management

That the Board approve and authorize the Chairman to sign the Permission to Enter Property - Non-Source Agreement with the State of Florida, Department of Environmental Protection (FDEP), to locate contamination, determine contamination levels, and when necessary, remove and remediate contamination which may be performed by the FDEP and its contractor. Specifically, to improve the existing road including one existing box culvert and one bridge, and construct a temporary culvert bridge over the Clark Sand Pond outfall to allow truck access for regrading and capping the Former Omni-Vest Landfill, per FEDP's Remedial Action Plan.
BACKGROUND:
The former Omni-Vest Landfill (subject site), located at 4094 Idlewood Road, is a closed landfill with documented contamination as per Florida Department of Environmental Protection (FDEP) risk based corrective action criteria in Chapter 62-780, Florida Administrative Code (FAC), cleanup criteria in Chapter 62-777 FAC and landfill closure requirements Chapter 62-701 FAC, and FDEP’s Guidance For Disturbance and Use of Old Closed Landfills or Waste Disposal Areas in Florida (May2001). The FDEP has now dedicated funds to conduct site remediation and is seeking permission to use the adjacent County property at Jackson Lakes to access the subject site during the construction period. The FDEP proposes to improve the existing groundwork as well as construct road and bridge infrastructure to access the subject site as per the Draft Remedial Action Plan, dated May 1, 2008.
BUDGETARY IMPACT:
There is no budgetary impact associated with this recommendation.

The Permission to Enter Property - Non-Source Agreement was reviewed and approved as to form and legal sufficiency by Stephen G. West, Senior Assistant County Attorney.

IMPLEMENTATION/COORDINATION:
The Brownfield Coordinator and Department of Natural Resources Management staff will coordinate with applicable parties to implement the terms of the Agreement.
