RECOMMENDATION:
Recommendation Concerning the State-Funded Grant Agreement to Update the Hazardous Materials Facility Analysis Data - John S. Dosh, Interim Public Safety Department Director

That the Board take the following action regarding the State-Funded Grant Agreement between the State of Florida, Division of Emergency Management, and Escambia County, providing performance-based funding to the Escambia County Division of Emergency Management, in the amount up to $11,707, to update the Hazardous Materials Facility Analysis Data, for the period ending June 30, 2020:

A. Approve the State-Funded Grant Agreement between the State of Florida, Division of Emergency Management, and Escambia County; and

B. Authorize the Chairman or Vice Chairman to execute the Grant Agreement and all related documents as required to implement this Grant.

The County Attorney's Office has requested that the Board be made aware of the following language within the Agreement:

Section (21) Mandated Conditions, Subsection b, that "This Agreement shall be construed under the laws of the State of Florida, and venue for any actions arising out of this Agreement shall be in the Circuit Court of Leon County."

BACKGROUND:
The State of Florida, Division of Emergency Management (FDEM) contracts with Escambia County each year to update the local Hazardous Materials Site-Specific Analysis Data for facilities that use, store, and/or manufacture hazardous materials. Upon approval of this Grant Agreement, the Escambia County Division of Emergency Management will be paid up to $11,707 for providing contract deliverables in the effort to update this data by June 30, 2020.
BUDGETARY IMPACT:
State funds are being provided in an amount up to $11,707, with no match requirement. Funds for this Grant will be identified in Fund 110, Other Grants and Projects, Cost Center 330323.
LEGAL CONSIDERATIONS/SIGN-OFF:
Kristin Hual, Senior Assistant County Attorney, has certified that this Grant Agreement is approved as to form and legal sufficiency.
PERSONNEL:
N/A
POLICY/REQUIREMENT FOR BOARD ACTION:
Board of County Commissioner's policies require Board approval for Grant Contracts.
IMPLEMENTATION/COORDINATION:
Coordination of this Grant Agreement will be between FDEM and the Escambia County Division of Emergency Management, along with site inspections coordinated with local hazardous materials facilities.
