RECOMMENDATION:
Recommendation Concerning the Emerald Coast Regional Council f/k/a/ West Florida Regional Planning Council Interlocal Agreement - Janice P. Gilley, County Administrator

That the Board take the following action regarding the Interlocal Agreement between Bay County, Escambia County, Holmes County, Okaloosa County, Santa Rosa County, Walton County and Washington County, Florida, and Emerald Coast Regional Council f/k/a West Florida Regional Planning Council:

A. Approve the Interlocal Agreement between Bay County, Escambia County, Holmes County, Okaloosa County, Santa Rosa County, Walton County and Washington County, Florida, and Emerald Coast Regional Council f/k/a West Florida Regional Planning Council;

B. Authorize the Chairman to execute the Interlocal Agreement; and

C. Authorize the County Administrator or her designee to pay annual dues by December 1st of each fiscal year.
BACKGROUND:
The Emerald Coast Regional Council, f/k/a as the West Florida Regional Planning Council (ECRC) is an agency created by the legislature of the State of Florida for the purpose of coordinating transportation planning activities for counties and municipalities in Northwest Florida. ECRC is the transportation staffing for the Florida-Alabama Transportation Planning Organization (TPO) serving  Escambia County.

Section 163.01, Florida Statutes, permits local governmental units to make efficient use of their powers by enabling them to enter into Interlocal Agreements to cooperate with other local governmental units on a basis of mutual advantage and thereby to provide services and facilities in a manner and pursuant to forms of governmental organization that will accord best with geographic, economic, population, and other factors influencing the needs and development of local communities.

ECRC serves the citizens of Escambia County by providing professional transportation planning, coordinating, and advisory services to local governments, state and federal agencies and the public in order to preserve and enhance the quality of life in Northwest Florida.

Each of the Counties desires to engage ECRC to serve the County in an advisory capacity to provide area-wide coordination and related cooperative activities of federal, state and local governments and to serve as a broad-based regional organization that can provide a regional perspective, enhancing the ability and opportunity for local governments to resolve issues and problems transcending jurisdictional boundaries within the realm of transportation.

As part of the Metropolitan Planning Organization process (MPO/TPO's), the federal government requires a mandatory local cash match to be met. ECRC is a regional resource serving seven counties within Northwest Florida. ECRC breaks down the total federally-required match by population and includes this portion in the annual dues invoice for those Counties within a TPO boundary. Annual dues are paid annually to ECRC to fund both ECRC and TPO functions.

No later than December of each year, ECRC's Board of Directors shall approve annual dues for the following year. For example, in December 2020, ECRC's Board will adopt annual dues for the fiscal year beginning October 1, 2021, and ending September 30, 2022. Annual dues shall be a base fee plus a per capita amount as determined by ECRC's Board of Directors. In Fiscal Year 2020, Escambia County paid $21,289 in annual dues.

According to the Interlocal Agreement, a city or town that does not pay its annual dues by December 1 of the year shall lose all voting privileges and will cease to be a member of ECRC's Board of Directors.
BUDGETARY IMPACT:
No later than December of each year, ECRC's Board of Directors shall approve annual dues for the following year. For example, in December 2020, ECRC's Board will adopt annual dues for the fiscal year beginning October 1, 2021, and ending September 30, 2022. Annual dues shall be a base fee plus a per capita amount as determined by ECRC's Board of Directors. 

In Fiscal Year 2020, Escambia County paid $21,289 in annual dues from General Fund 001, Cost Center 110201, Object Code 58205.
LEGAL CONSIDERATIONS/SIGN-OFF:
Kia M. Johnson, Assistant County Attorney, has reviewed the Interlocal Agreement and approved it as to form and legal sufficiency.
PERSONNEL:
No additional personnel required.
POLICY/REQUIREMENT FOR BOARD ACTION:
BCC Policy requires Board approval for Interlocal Agreements.
IMPLEMENTATION/COORDINATION:
Upon approval, staff will transmit the signed Interlocal Agreement to ECRC.
