RECOMMENDATION:
Recommendation Concerning the Grant Agreement Providing Fiscal Year 2019/2020 - 2022/2023 Section 5311 Non-Urbanized Area Formula Program (CARES Act) Grant Funding to Escambia County Mass Transit Department - Tonya Ellis, Mass Transit Director

That the Board take the following action concerning State of Florida Department of Transportation Public Transportation Grant Agreement (PTGA), Financial Project Number 447494-1-84-01, providing Fiscal Year 2019/2020 - 2022/2023, Section 5311 Non-Urbanized Area Formula Program (CARES Act) Grant Funding to the Mass Transit Department:

A. Approve the PTGA, Financial Project Number 447494-1-84-01, providing for Florida Department of Transportation (FDOT) participation in the amount of $541,960, of Fiscal Year 2019/2020 - 2022/2023 funding to Escambia County Area Transit (ECAT);

B. Adopt the Resolution authorizing the Application and acceptance of these funds; and

C. Authorize the Chairman to execute the Resolution, PTGA, and all other documents pertaining to this PTGA without further action of the Board.

Please note Section 19 (j) of the PTGA, which requires the County to waive forum and venue.

[Funding: The funding is provided at 100% reimbursement and no match is required by Escambia County. There will be no additional costs to the County as a result of this action.]
BACKGROUND:
The Section 5311 Non-Urbanized Area Formula Program provides Federal operating dollars to eligible recipients who operate/contract public transportation service in non-urbanized areas (Rural)  Eligible recipients may receive annual Section 5311 allocations to offset operational expenses of public transportation service operated/contracted in non-urbanized areas.  Currently the only route operated in the non-urbanized area is Route 60.

On September 5, 2019, the Board approved the acceptance of Fiscal Year 2019/2020 5311 Non-Urbanized funding, in the amount of $180,271, which has a match requirement of 50%. As part of the CARES ACT, this PTGA allows for $541,960 in 5311 funding at 100% reimbursement of costs. The Grant Agreement begins on execution and expires February 28, 2023. Instruction received from the FDOT is that CARES ACT funds will be utilized before regular 5311 funding, therefore these funds will replace the original funds awarded to Escambia County after the 2nd Quarter of Fiscal Year 2019/2020. 

Escambia County's Mass Transit Department was awarded CARES ACT funding, as the FTA Direct Recipient of 5307 funding.  The FDOT is the Direct Recipient for 5311 funding and therefore is the reason these funds are passed through from the FDOT.
BUDGETARY IMPACT:
These funds do not require a match. The Mass Transit Department will utilize the original 5311 funds for the first two quarters of Fiscal Year 2019/2020, and upon execution will then begin to use the CARES ACT 5311 funds for the non-urbanized area.
LEGAL CONSIDERATIONS/SIGN-OFF:
Kristin Hual, Senior Assistant County Attorney, has approved the PTGA and the Resolution as to form and legal sufficiency.

IMPLEMENTATION/COORDINATION:
Mass Transit staff will continue to coordinate with the Florida Department of Transportation staff to complete all implementation requirements.
