RECOMMENDATION: |
Recommendation Concerning the Acquisition of Properties Located at 3816, 3818, and 3830 Frontera Circle – Keith Wilkins, Community & Environment Department Director
That the Board take the following action concerning the acquisition of property located at 3816, 3818, and 3830 Frontera Circle:
A. Rescind the following action of the Board of County Commissioners on April 18, 2013:
1. Authorizing the purchase of the parcels of real property (totaling approximately 0.16 acres) from the Harvey D. Jordan Revocable Trust, for the negotiated amount of $12,400, in accordance with the terms and conditions contained in the Contract for Sale and Purchase;
2. Approving, subject to Legal review and sign-off, the Contract for Sale and Purchase for the acquisition of the parcels or real property located at 3816, 3818, and 3830 Frontera Circle; and
3. Authorizing the County Attorney to prepare, and the Chairman or Vice- Chairman to execute, subject to Legal review and sign-off, any documentation necessary to complete the acquisition of the parcels without further action from the Board;
B. Authorize the purchase of the three parcels from the Harvey D. Jordan Revocable Trust, for a purchase price of $12,400, in accordance with the terms and conditions in the (amended) Contract for Sale and Purchase;
C. Authorize payment of incidental expenses associated with acquiring the properties as well as documentary stamps because the properties are being purchased by the County to alleviate the blighted conditions in the Whispering Oaks Subdivision, as part of a Community Revitalization Plan approved by the Board on August 18, 2011;
D. Authorize the County Attorney to prepare and the Chairman or Vice Chairman to execute all documents necessary to complete the acquisition of the parcels without further action from the Board; and
E. Authorize payment of the County’s real estate brokerage fees under one of the following two options:
Option 1) Treat the purchase of the parcels as a single transaction, for the purpose of calculating the brokerage fee, and authorize payment of $500 to Sell Florida Homes, Inc.
Or
Option 2) Treat the purchase of the parcels as three separate transactions, for the purpose of calculating the brokerage fee, and authorize payment of $1,500 to Sell Florida Homes, Inc.

BACKGROUND: |
The Board previously authorized acquisition of the three parcels from the Harvey D. Jordan Revocable Trust on April 18, 2013. The (amended) Contract for Sale and Purchase accompanying this recommendation rescinds and replaces the original contract to include as part of the County’s consideration required by the Seller cancellation of certain code enforcement and other local government liens that were not included in the original contract.
The County retained the services of a real estate broker, Sell Florida Homes, Inc., to assist with the acquisition of the properties on Frontera Circle. The relevant portion of the County’s Agreement for Real Estate Brokerage Services with Sell Florida Homes, Inc. provides that the broker will receive “a minimum of $500 per transaction.” Although three parcels are involved, this property acquisition is, and has been treated as, a single transaction. However, the local agent for Sell Florida Homes, Inc. has related to the County staff that she expects to receive a commission of $1,500 ($500 per parcel).

BUDGETARY IMPACT: |
Funds for this project are available in the Community Redevelopment Agency Fund 151/ Cost Center 220515 CRA Brownsville/ Object Code 56101.
The amounts that otherwise would be due to satisfy and cancel the various code enforcement liens encumbering the property, which the Seller requires the County to cancel, are as follows:
Court Costs: $ 4,400.00
Abatement Costs: $ 14,800.00
Administrative Fines: $135,500.00
TOTAL: $154,700.00

LEGAL CONSIDERATIONS/SIGN-OFF: |
The County Attorney’s Office will prepare the closing documents and conduct the closing for the purchase of the property. The Contract for Sale and Purchase was approved as to form and legal sufficiency by Stephen West, Senior Assistant County Attorney.

These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances. |
