RECOMMENDATION:
Recommendation Concerning Acceptance of a Quit Claim Deed from The Ensley Fire Department, Incorporated - Michael D. Weaver, Public Safety Department Director

That the Board take the following action concerning the acceptance of the Quit Claim Deed from The Ensley Fire Department, Incorporated:

A. Accept the Quit Claim Deed from The Ensley Fire Department, Incorporated, (a/k/a the Ensley Volunteer Fire Department, Inc.);

B. Authorize the Chairman to sign the Deed and any other documents necessary to complete the transaction; and

C. Authorize payment of the incidental expenses associated with recording the Deed in the Public Records.
BACKGROUND:
In 1982, the County conveyed property to The Ensley Fire Department, Incorporated.  The deed included a reverter clause so that the property would automatically revest with the County if The Ensley Fire Department, Incorporated, stopped using it for firefighting purposes.  The Ensley Fire Department, Incorporated, dissolved in 2010, and the surviving directors of the corporation have executed a quit claim deed to confirm that title to the property has returned to the County.
BUDGETARY IMPACT:
Only incidental expenses associated with recording the deed in public records.
LEGAL CONSIDERATIONS/SIGN-OFF:

Assistant County Attorney Stephen G. West drafted the deed and has approved the document as to form and legal sufficiency on May 30, 2013.

POLICY/REQUIREMENT FOR BOARD ACTION:
Acceptance of deeds require approval by the Board of County Commissioners.
IMPLEMENTATION/COORDINATION:

Once approved the County Attorney's Office will execute the required documents.
