RECOMMENDATION:

Recommendation Concerning Settlement of a Workers' Compensation Claim Involving Sandra Ammons

That the Board approve an additional $16,003.40 for a washout workers' compensation settlement for former employee Sandra Ammons. An excess workers' compensation carrier shall reimburse Escambia County for 100.0% of this settlement amount.

BACKGROUND:

On July 11, 2013, the Board approved a washout workers' compensation settlement for former employee Sandra Ammons in the amount of $152,534.00. (Resume attached.) This settlement was negotiated directly between the County's third-party adjuster, PGCS, Inc., and Ms. Ammons. The County has exceeded its self-insured retention limit for the claim and an excess workers' compensation insurance carrier shall reimburse the County for 100.0% of the settlement amount. The Center for Medicaid Services has approved a Medicare set-aside allocation as part of this settlement.

Subsequent to receiving Board approval for the settlement, Ms. Ammons retained an attorney to review the settlement documents and to assist her with the claim. She is now requesting an additional $16,003.40 to settle the claim, which will be inclusive of a statutory attorney's fee. The excess workers' compensation insurance has approved the additional amount and will reimburse the County for 100.0% of this additional amount.

BUDGETARY IMPACT:

Reserves are coordinated through Risk Management and the County's third-party carrier, Preferred Governmental Claims Solutions. Monies are paid out of Fund 501, Account 239898.
