RECOMMENDATION:
Recommendation Concerning the State Road 10 (US 90A - Nine Mile Road) Turn Lane - Locally Funded Agreement - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the State Road 10 (US 90A - Nine Mile Road) Turn Lane - Locally Funded Agreement:

A. Adopt the Resolution supporting the installation of a directional left turn lane on State Road 10 for westbound traffic to Louise Avenue and authorizing the Chairman to sign the Locally Funded Agreement between the State of Florida, Department of Transportation and Escambia County - Project 416940-1-52-07; and

B. Approve the Locally Funded Agreement between the State of Florida, Department of Transportation and Escambia County - Project 416940-1-52-07.

BACKGROUND:
The Florida Department of Transportation (FDOT) proposed several modifications along Nine Mile Road, one of which included closing the median opening for Louise Avenue.  County staff met with the FDOT Access Management Review Committee, and were able to encourage said committee to modify the proposed plans, but the modifications did not include allowing traffic to turn left directly onto Louise Avenue from westbound Nine Mile Road.

As part of this Locally Funded Agreement, Escambia County is agreeing to pay for the construction of a directional left turn lane for westbound traffic to Louise Avenue. 

Legal has a few concerns which are:

1.  No provision capping the County's funding obligations;

2.  No provision requiring mutual agreement for any budget increase; and

3.  The FDOT may unilaterally remove the turn lane without reimbursing any of the County's costs.
BUDGETARY IMPACT:
Anticipated project cost is $40,251.  According to the LFA, the $40,251 is the contractor's cost estimate plus 10%.

Funds are available in Fund 352 ‘LOST III”, Account 210107/56301, Project #13EN2535, "Nine Mile at Louise Avenue".

LEGAL CONSIDERATIONS/SIGN-OFF:

This was reviewed and signed off on by the Legal Department with the understanding that they do have some concerns and would like these brought up for discussion.

PERSONNEL:
Additional personnel will not be required as a result of this Locally Funded Agreement.
POLICY/REQUIREMENT FOR BOARD ACTION:

IMPLEMENTATION/COORDINATION:
Upon the Board’s approval of this recommendation, the Chairman will need to sign five original copies of the Locally Funded Agreement. The Clerk’s office will then need to certify five copies of the Resolution for FDOT and retain the original for the official records. Transportation and Traffic Operations staff will forward the five signed original copies of the Agreement and five certified copies of the Resolution to FDOT for final signatures and for their files.  The Clerk's office will furnish FDOT a check in the amount of $40,251 within seven days of this Agreement.
