RECOMMENDATION:
Recommendation Concerning Granting a Conservation Easement to Northwest Florida Water Management District for the Brookhollow Subdivision Drainage Project - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning granting a Conservation Easement to Northwest Florida Water Management District for the Brookhollow Subdivision Drainage Project:

A. Approve the Conservation Easement between Escambia County and Northwest Florida Water Management District to permit wetland impacts associated with the Brookhollow Subdivision Drainage Project;

B. Authorize the payment of incidental expenditures associated with the recording of the documents; and

C. Authorize the Chairman to sign the Conservation Easement and any other documents associated with the granting of the conservation easement.

BACKGROUND:
Escambia County has a project in design to make improvements in the Brookhollow Subdivision area located off Ten Mile Road.  Based on engineering design, the County has constructed a surface water management system, as permitted by the Northwest Florida Water Management District (in accordance with Environmental Resource Permit #1309), which includes water quality treatment and flood relief for the basin located within the Brookhollow Subdivision. 

The permit associated with this project authorizes impacts to 0.6 acres of low-quality wetlands for construction of a stormwater detention pond on Ten Mile Road.  Impacts to water resources are offset by improving the downstream watershed through stormwater treatment and attenuation via this new detention pond, and by enhancement and preservation of wetlands and upland buffers within the Brookhollow Subdivision, on Eagle Terrace.  This conservation easement is a condition of Environmental Resource Permit #1309, and will offset and reduce adverse impacts to water quality and natural resources including fish, wildlife, wetlands and other surface water areas.
BUDGETARY IMPACT:
Funds for incidental expenditures associated with the recording of documents are available in Engineering Escrow account accessed by the Escambia County Clerk’s Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Conservation Easement document was approved as to form and legal sufficiency by Stephen West, Assistant County Attorney, on September 5, 2013.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
This recommendation is consistent with the Board’s adopted Comprehensive Plan goal to “properly manage and conserve the important natural resources of the County…"
IMPLEMENTATION/COORDINATION:
Once the easement has been approved and executed by the Chairman, it will be recorded in the public records of Escambia County, Florida.
