RECOMMENDATION:
Recommendation Concerning the Acceptance of a Drainage and Access Easement from Mleaf Ventures, LLC, and Maple Leaf Estates Owners Association, Inc. - Joy D. Blackmon, P.E., Public Works Department Director 

That the Board take the following action concerning the acceptance of a Drainage and Access Easement from Mleaf Ventures, LLC, and Maple Leaf Estates Owners Association, Inc.:

A. Accept the donation of the Drainage and Access Easement from Mleaf Ventures, LLC, and Maple Leaf Estates Owners Association, Inc., for the Maple Leaf Estates Drainage Project;

B. Authorize the payment of documentary stamps, as the drainage and access easement is being donated for governmental use, which is for stormwater drainage and infrastructure, as the County benefits from the acceptance of this Drainage and Access Easement, which enhances the safety and well-being of the citizens of Escambia County;

C. Authorize the payment of incidental expenditures associated with the recording of documents; and

D. Authorize staff to prepare, and the Chairman or Vice Chairman to accept, the Drainage and Access Easement as of the day of delivery of the Drainage and Access Easement to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

BACKGROUND:
Hummingbird Boulevard and Maple Leaf Estates Subdivision (a private subdivision located east of Music Lane and west of Hummingbird Boulevard) has a history of stormwater drainage issues.  Escambia County has plans in design to construct drainage improvements to reduce stormwater and drainage concerns within this area.  Design indicated the need for a drainage easement from Mleaf Ventures, LLC., the property owner lying north of Maple Leaf Estates Subdivision, and Maple Leaf Estates Owners Association, Inc.  The property owners are willing to grant the drainage and access easement to the County in order to facilitate this drainage project.
BUDGETARY IMPACT:
Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by Escambia County Clerk's Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Drainage and Access Easement was approved as to form and legal sufficiency by Stephen West, Assistant County Attorney, on September 5, 2013.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will proceed in compliance with Section 46-139 of the County Code of Ordinances.
